HD. ’ g 73- ESTABLISH A PRIMA FACIE SPEED LIMIT MTG. 12/07/99 UPON POINSETTIA LANE I RECOMMENDED ACTION: Introduce Ordinance No. ~-523 to establish a prima facie 45 mile per hour speed limit upon Poinsettia Lane from Paseo del Norte to Black Rail Road. I ITEM EXPLANATION: Poinsettia Lane has been recently extended from Aviara Parkway to Black Rail Road. Although designated as a major arterial on the Circulation Element of the General Plan, this road segment has been partially constructed to major arterial standards with one traffic lane and one bicycle lane in each direction, separated by a raised median. The road segment of Poinsettia Lane from Paseo del Norte to Aviara Parkway has been constructed to its full four lane, divided roadway configuration in accordance with City standards for a 50 mile per hour design speed. Poinsettia Lane from Paseo del Norte to Black Rail Road is 1.37 miles in length and has an average daily traffic (ADT) volume of 19,900 vehicles east of Paseo del Norte and 1,700 vehicles east of Aviara Parkway. Parking is prohibited on both sides of the roadway. Currently, Poinsettia Lane is posted as a 40 mile per hour speed zone from Paseo del Norte to Aviara Parkway, with the road segment from Aviara Parkway to Black Rail Road being unposted. Sections 22357 and 22358 of the California Vehicle Code authorizes local authorities to establish a prima facie speed limit on the basis of the results of an Engineering and Traffic Survey. The Engineering and Traffic Survey considers such factors as the number of collisions that have occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight distance, and conditions that may not be readily apparent to the driver. At their meeting on November 1, -1999, the Traffic Safety Commission considered the results of the Engineering and Traffic Survey to establish a prima facie speed limit upon Poinsettia Lane. The Commission recommended by a 4-O vote to establish a 45 mile per hour prima facie speed limit upon Poinsettia Lane from Paseo del Norte to Black Rail Road, thereby raising the existing 40 mile per hour speed limit between Paseo del None and Aviara Parkway. The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic Engineer. FISCAL IMPACT: Installing eight speed limit signs on Poinsettia Lane between Paseo del Norte and Black Rail Road will cost about $1,000. EXHIBITS: 1. Location Map. 2. Ns- 533 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE REVISION OF SECTION 10.44.360 TO ESTABLISH A PRIMA FACIE 45 MILE PER HOUR SPEED LIMIT UPON POINSETTIA LANE FROM PASEO DEL NORTE TO ITS INTERSECTION WITH BLACK RAIL ROAD. The City Council of the City of Carlsbad, California, hereby ordains as follows: SECTION 1: That Title 10, Chapter 10.44 of the Carlsbad Municipal Code is amended by the revision of Section 10.44.360 to read as follows: “10.44.360 Poinsettia Lane: a. Upon Poinsettia Lane from Carlsbad Boulevard to its intersection with Paseo del Norte the prima facie speed limit shall be thirty-five miles per hour. b. Upon Poinsettia Lane from Paseo del Norte to its intersection with Black Rail Road the prima facie speed limit shall be forty-five miles per hour.” EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen (15) days after its adoption.
