RECOMMENDED ACTION:
Adopt Resolution No. 8 O** - 1 9 authorizing the mayor to donate two surplus
police vehicles to the Palomar College Criminal Justice Program.
ITEM EXPLANATION:
Beginning on June 11, 1996, the City Council approved Resolution No. 96-202,
authorizing the lease of two surplus police vehicles to the Palomar College Criminal
Justice Program for the sum of $1 each. That lease expired and was renewed by
Resolution 98-197 extending the lease agreement through May 13, 2000. At the end of
this lease agreement the two vehicles, both 1992 Ford Crown Victorias, were estimated
to have a value of less than $1,000 each.
Due to the fact that Palomar College is still using the vehicles in their program, both
for training and general law enforcement purposes, they have requested that the
vehicles be donated to the college at the end of the current lease, thereby relieving the
City of any further responsibility of the vehicles.
FISCAL IMPACT:
The value of the vehicles, based upon the estimate at the beginning of the lease,
would be less than $1,000 each.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLSBAD, CALIFORNIA, APPROVING
THE DONATION OF TWO POLICE VEHICLES
TO PALOMAR COLLEGE
WHEREAS, the City Council of the City of Carlsbad, California does
hereby resolve as follows:
1. That the two surplus police vehicles herein noted be donated
to Palomar College for use as they see fit in their Criminal Justice
Department.

2. That the Mayor of the City of Carlsbad is hereby authorized and

necessary documents through required agencies to facilitate transfer of
the title of the vehicles to Palomar College.

ITEM EXPLANATION:
On June 11, 1996, the City Council approved Resolution No. 96-202 authorking the iease of two
sutpks poke vehicles to the Palomar College Criminal Justice Program for the sum of $1 each. the
lease expires June 12,1998, and the college has t-%juested a two-year extension of the Iease utilizing
the same two vehides.
FISCAL IMPACT:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING VEHICLE LEASE
AGREEMENT WITH PALOMAR COLLEGE.
WHEREAS, the City Council of the Ci Council of the City of Carlsbad, California does
weby resolve as follows.
1. That the Vehide Lease Agreement attached hereto as Exhibit Number One between
the City of CM&ad and the Palomar College is hereby approved.
2 That the Maw of the City of Carlsbad is hereby authorized and directed to execute
said agreement for and on behalf of the city of Cadsbad, California, on the 23rd day of
June 1998.

THIS AGREEMENT is made effective May IS, 1998, between the City ofcatlsbad, a
municipal corpotation ofthe State ofCali&nia, and thepalomar Community College District, dba Palomar College, a public entity of post secondary education operating in
the State ofcalifornia.
WHEREAS, the City of Carlsbad (haeinafta the “City”), and the Pahnar Cornrnunity
College Dishict, dbn Palomar College (hereinafkr the “College”), entered into a lease of
City surplus police vehicles effective 13 June 19%; and,
WHEREAS, the term of the lease agreement ends on May 14, I 998, and the City and College desire to extend the agreement by an additional two year period; a&,
WHERE&, the City CDntilulcs to carry the subject vehicles on its inventory as “surplw”
and d- not have a present need to use these vehicles in its Poke or hkw enfofcement
effort% and,
WHEREAS, the College has a conthing need to use the subject vehicles in its Police
Training Programs, and in the Administration of Justice program;
NOW THFSEFORE, in consideration of the above recitals, the substance of which is
incorpwated herein by this reference, City and College agree:
1. ‘lb term of the lease, which expires May 14,1998, is hereby extended for
additional two c&&w years, and shall now expire on May 13,2CKKI.
2. As additional considmtion for the Iease oftk subject vehicles, receipt of which
is hereby acknowkdged, the College pays to the City the sum of one dollar ($1 .OO) f& both vehicles for the additional two year term.

Dear Chief Vales:
As you know, cur District has an agreement with the City of Carlsbad for the lease of
the following surplus police vehicles, expiring .May 13,200O.

These vehicles are being used for training purposes in our Police Academy program.
The District is interested in using these vehicles in our on-campus Police Department.
On September 8, 1999 we wrote you regarding our District acquiring title to these
vehicles, out right. Please consider this follow-up letter as our request for the subject
vehicles be considered for donation to the District.
We believe that the City of Carlsbad no longer needs the vehicles, and we hrther
believe that they have minimal economic value to the City. Since we propose to use the
vehicles not only for training, but also for general law enforcement, it would seem
prudent for the City to relieve itself of any further responsibility for them, by making an
outright donation by transfer of the titles through DMV, directly to Palomar, and as a
donation from one public entity to another.
