ADOPTION OF THE 1997 UNIFORM CODE FOR THE
ABATEMENT OF DANGEROUS BUILDINGS, 1997
UNIFORM SWIMMING POOL AND HOT TUB CODE, AND
DEPT. BLD THE 1997 UNIFORM SOLAR ENERGY CODE

It is recommended that the City Council INTRODUCE Ordinance No. gs* 53 1 to adopt by
reference the 1997 Uniform Swimming Pool and Hot Tub Code, the 1997 Uniform Solar Energy Code,
and the 1997 Uniform Code for the Abatement of Dangerous Buildings.
ITEM EXPLANATION:
Title 18 of the Carlsbad Municipal Code adopts by reference certain nationally published Codes, such
as the Uniform Building Code, for regulating the maintenance of existing buildings and construction of
new buildings and accessory structures.
Carlsbad Municipal Code Chapter 18.17 adopts by reference the 1991 Uniform Swimming Pool, Spa,
and Hot Tub Code as published by the international Association of Plumbing and Mechanical Officials
(IAPMO). Staff is recommending adoption of the 1997 version of this same document to maintain
compatibility with the 1997 Uniform Plumbing Code. Staff is also recommending that Section 1 .l 1
Cost of Permit not be included in the adoptive ordinance. The fee contained therein conflicts with
fees established in the adopted Building and Plumbing Codes.
Chapter 18.18 of the Carlsbad Municipal Code adopts by reference the Uniform Solar Energy Code.
Staff is recommending adoption of the 1997 edition of that same document as published by IAPMO.
The Uniform Solar Energy Code is the companion document to the Uniform Plumbing Code. This
action will maintain consistency between the two adopted codes. It is also recommended that Section
109. Cost of Permit not be included in the adoptive ordinance. The fee contained therein conflicts
with fees established in the adopted Building and Plumbing Codes.
Carlsbad Municipal Code Chapter 18.19 adopts by reference the 1991 Edition of the Uniform Code for
the Abatement of Dangerous Buildings. Staff is recommending adoption by reference of the 1997
Edition of the Uniform Code for the Abatement of Dangerous Buildings. This Code is applicable to all
structures except residential occupancies and sets forth procedures for abating dilapidated, defective
buildings which endanger life, health, property, or public safety. The change in documents will
maintain compatibility with the 1997 Uniform Building Code and the 1997 Uniform Housing Code,
the City’s building and housing codes.
FISCAL IMPACT:
No fee increase is proposed by this ordinance. The City will incur no additional costs by the adoption
of this ordinance.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, AMENDING TITLE 18, CHAPTER 18.17.
18.18, AND 18.19 OF THE CARLSBAD MUNICIPAL CODE
TO ADOPT BY REFERENCE THE UNIFORM SWIMMING
POOL, SPA, AND HOT TUB CODE (1997 EDITION), THE
UNIFORM SOLAR ENERGY CODE (1997 EDITION), AND
THE UNIFORM CODE FOR THE ABATEMENT OF
DANGEROUS BUILDINGS (1997 EDITION)
The City Council of the City of Carlsbad, California does ordain as follows:
SECTION 1: That Title 18, Chapter 18, Section 18.17.010 of the Carlsbad Municipal
Code is modified to read:
18.17.010 Adontion of the Uniform Swimming. Sna, and Hot Tub Code. The Uniform
Swimming Pool, Spa, and Hot Tub Code, 1997 Edition, copyrighted by the International
Association of Plumbing and Mechanical Officials, except Section 110.0 FEES, is adopted by
reference as the City swimming pool, spa, and hot tub code.
SECTION 2 : That Title 18, Section 18.18.010 of the Carlsbad Municipal Code is
modified to read:
18.18.010 Adoption of the Uniform Solar Enernv Code. The Uniform Solar Energy
Code, 1997 Edition, copyrighted by the International Association of Plumbing and Mechanical
Officials, except Section 109.0 Cost of Permit, is adopted by reference as the City solar energy
code.
SECTION 3: That Title 18, Section 18.19.010 of the Carlsbad Municipal Code is
modified to read:
18.19.010 Adontion of the Uniform Code for the Abatement of Dangerous Buildings.
The Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition, copyrighted by the
International Conference of Building Officials, is adopted by reference as the City dangerous
building code.
EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption,
and the City Clerk shall certify to the adoption of this ordinance and cause it to be published at
least once in a newspaper of general circulation in the city within fifteen days after its adoption.
