I RECOMMENDED ACTION: Adopt Resolution No. 2000 -128 authorizing the application for federal Intermodal Surface Transportation Efficiency Act (ISTEA) TEA-21 funding for the Coastal Rail Trail and the Palomar Airport Road and l-5 Interchange. I ITEM EXPLANATION: In 1998, President Clinton signed into law the Transportation Equity Act for the 21” Century (TEA-21) which builds on the major changes to federal transportation policy and programs addressed in the Intermodal Surface Transportation Efficiency Act of 1992 (ISTEA). Under the provisions of TEA-21, California is expected to receive about $410 million for the Enhancement program through FY 2004. SANDAG’s share of the regional allocation is $22.6 million. SANDAG has developed guidelines and procedures for the allocation of these funds and has established priority allocation for funding of projects that fit into one of the following four categories: 0 Transit Oriented Development 0 Regional Corridor and Feeder Bikeways 0 Scenic Viewsheds or Wildlife Corridor Acquisition 0 Corridor/Gateway Enhancements Transportation Enhancement funds are to be used for transportation related projects that enhance the quality-of-life in or around transportation facilities. Projects must be directly related to the transportation system and must provide a level of improvement above and beyond any required mitigation. The proposed projects should have a quality of life benefit while providing the greatest benefit to the greatest number of people. Transportation Enhancements must protect the environment and provide a more aesthetic, pleasant and improved interface between the transportation system for the communities and people adjacent to the transportation facility. SANDAG initially solicited applications for proposed projects in early October of this year. The deadline for application submittal was December 1, 1999. Due to the short duration of the application period, SANDAG made provisions in the application process for agencies to submit applications, prior to authorization by the agencies governing board, provided that such authorization is made in a timely fashion after the submittal deadline. Should Council decide not to authorize one or both of the submitted applications, the application(s) will be returned by SANDAG without penalty or jeopardizing the status of current or future applications. Based on the provisions of the TEA-21 program, staff is recommending that the City Council authorize the application for funding to support the following two (2) projects: Coastal Rail Trail - The City of Carlsbad has been designated as the lead agency for this multi-jurisdictional non-motorized path within the San Diego Northern Railway right-of-way. The Project Study Report, preliminary design plans and the CEQA and NEPA documents have been completed and were funded with monies from the first round of the ISTEA program. In the past three years, the City has secured approximately $7.5 million from various state and federal sources to support the next phases of the project. Staff estimates that an additional $5.1 million in TEA-21 funds is necessary to complete the design, permitting, right-of-way agreements, and construction of 17.6 miles of path between the Oceanside and Solana Beach Transit Stations. I h - Page 2 of Agenda Bill No. 1~; fti Landscapina of the Palomar Airport Road and l-5 lnterchanae - In 1999, the Council approved the l-5 Corridor Landscape Master Plan identifying various landscape beautification projects within the highway corridor. The Master Plan recommended that the first project to be pursued is the landscaping of the interchange at l-5 and Palomar Airport Road. Based on the cost estimates in the Master Plan, staff estimates that the landscaping and enhancements at this interchange can be completed for $505,500. ENVIRONMENTAL IMPACT: Submittal of these two grant applications does not irrevocably commit the City to proceed with the projects, nor do they commit the City to providing the necessary financial matching funds. However, if one or both of these projects are selected for funding, the City would need to complete the necessary environmental analysis before the execution of the supplemental agreements with Caltrans. FISCAL IMPACT: TEA-21 funds can only be applied to design, environmental studies, land acquisition and construction activities. Funds may not be spent on normal habitat mitigation which is required of the base project. Proposed projects must demonstrate that adequate funding will be available to maintain the constructed facility for its lifetime (20 years). In addition, any funded project is required to follow federal regulation and obtain NEPA clearance. A provision of the TEA-21 program is the requirement to secure 11.5% in matching funds. Due to the regional nature of the Coastal Rail Trail project, the SANDAG Bicycle and Pedestrian Advisory Committee has recommended that the matching share be provided from the TransNet Bicycle account. Therefore, no local matching funds are being committed for this project. The application for this project states that maintenance of the constructed rail trail facility will be the responsibility of the respective cities through which the rail trail passes. By approving this application, Council is making a commitment to fund maintenance of that portion of the trail which lies within the Carlsbad city limit for a period of 20 years. Maintenance costs are estimated at $50,000 per year. The landscape improvements at the l-5 and Palomar Airport Road Interchange requires a local match in the amount of $58,130. If the project application is approved for TEA-21 funding, staff will include the project in the Fiscal Year 2000-2001 Capital Improvement Program budget together with a recommendation on the source of funds for the local match. The most likely source will be the General fund. The project application states that maintenance of the constructed facility will be shared by the City and Caltrans. The City will fund maintenance for the first four years through initial landscape establishment maintenance contracts. Caltrans is identified as having maintenance responsibilities thereafter. Caltrans has not committed to this arrangement, so the issue may need further resolution as the project progresses through the application process. Maintenance costs are estimated at $7,000 per year. Resolution No. JO00 -a$ authorizing the application for federal Intermodal Surface Transportation Efficiency Act (ISTEA) TEA-21 funding for the Coastal Rail Trail and the Palomar Airport Road and l-5 Interchange. _-. .- RESOLUTION NO. 2000-28 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AUTHORIZING THE APPLICATION FOR FEDERAL INTERMODAL SURFACE TRANSPORTATION EFFICIENCY ACT (ISTEA) TEA-21 FUNDING FOR THE COASTAL RAIL TRAIL AND THE PALOMAR AIRPORT ROAD AND l-5 INTERCHANGE. 6 WHEREAS, the San Diego Association of Government (SANDAG) has solicited from 7 cities projects that meet the criteria for possible lntermodal Surface Transportation Efficiency Act 8 (ISTEA) TEA-21 funding; and WHEREAS, the City of Carlsbad desires to request funding to support the construction of 9 the Coastal Rail Trail and the landscaping of the Palomar Airport Road and l-5 Interchange lo based on the criteria established in the TEA-21 program; and 11 WHEREAS, the Public Works Director has previously submitted applications to SANDAG I2 for funding for the Coastal Rail Trail and the landscaping of Palomar Airport Road and 13 l-5 Interchange projects. 14 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 15 1. That the above recitations are true and correct. 16 2.
