That the City Council ADOPT Resolutions No. 200d- 4 6 and &)ao * 1/9 AUTHORIZIN(
Estate Collateral Management (RECM) to prepare a Local Facilities Management Plan for
and an amended Local Facilities Management Plan for Zone 1 I.
ITEM EXPLANATION:
Carlsbad Municipal Code Section 21.90.1 20 describes the procedures for preparation o
Facilities Management Plan. In a zone where there are multiple owners, the owners m
submit a plan. However, if all of the owners in a zone do not consent to the preparation (
one or more owners may petition the City Council for permission to prepare the plan. Thr
for amending a plan is the same as for preparation.
In the present case, RECM is the owner of the majority of land in both zones. Zone 10 I
had a plan approved. The plan for Zone 11 was approved in 1988 and amended in 195
owners of undeveloped property in the zones have not consented to the preparation or an
of the plans. Therefore, RECM has written a letter to the City (Exhibit 3) requesting perr
prepare a new plan for Zone 10 and an amendment for Zone 11.
Staff supports RECM's request because it is necessary to have the Local Facilities Mar
Plans processed concurrently with the La Costa Master Plan that is now in review.
FISCAL IMPACT:
RECM will bear all costs related to preparation of the Zone 10 plan and Zone 11 amenc
addition, RECM will pay the required processing fee for a Local Facilities Management PIE
will be no fiscal impact to the City.

CARLSBAD, CALIFORNIA APPROVING A REQUEST TO
PREPARE A LOCAL FACILITIES MANAGEMENT PLAN FOR

The City Council of the City of Carlsbad, California, does hereby re

WHEREAS, Carlsbad Municipal Code Section 21.90.120 speci

Real Estate Collateral Management (RECM) recently contracted for the preparation of
amendments to the Local Facilities Management Plans for Zones 10 and 11. These
amendments are necessary to insure that the La Costa Master Plan and General Amendments
anticipated by the Habitat Conservation Plan Implementation Agreement are consistent with the
City’s Growth Management Program. Drafts of the proposed amendments have been submittec
to the City staff as part of the La Costa Master Plan Amendment process.
Attached is a list of property owners that were sent requests authorizing the preparation of the
amended plans. We have received 2 responses to date, as noted by asterisks. These
responses are attached.
In compliance with Section 21.90.120 (d) of the Carlsbad Municipal Code, Real Estate
Collateral Management hereby request that the City Counsel permit Real Estate Collateral
Management to prepare the subject Zone 10 and 11 Local Facilities Management Plan
Amendments on behalf of the Zone 10 and I1 Landowners.
Please schedule this request for the earliest possible City Council meeting.

Gentlemen:
The Villages of La Costa has been in the process of preparing a Local Facilities Management
Plan Amendment for Zone 11 in conjunction with the preparation of the Villages of La Costa
Master Plan. In 1995, the predecessor to the Villages of La Costa entered into an agreement
with federal, state and local governmental agencies for the conservation of environmentally
sensitive land within Zone 11. This agreement and the corresponding Habitat Conservation
Plan necessitated changes to the original La Costa Master Plan. In order to amend the master
plan to accommodate these changes, the Carlsbad Municipal Code requires the preparation of
a local facilities management plan Amendment for Zone 11 before any additional development
approval can be granted to any property owner.
The local facilities management plan serves to manage growth within the zone by ensuring that
the phasing of public and community facilities will be adequate to meet the needs of the
projected development within the City and the zone. Section 21.90.120 c of the Carlsbad
management zone to jointly prepare a local facilities management plan. The plan will be based
upon existing City approved land use designations for your property and will not propose
modifications to those approvals.
Since your property is located within Zone 11, your concurrence with the preparation of the plan
is requested, and will benefit you by removing one of the obstacles to future development.
Please execute the attached form signifying your concurrence and return by August 1 5ih.
