RECOMMENDED ACTION: Introduce Ordinance No. r\lS - S3 Y to amend the Carlsbad Municipal Code to replace those remaining references to “Elm Avenue” with% “Carlsbad Village Drive.” ITEM EXPLANATION: In 1987 , the City Council adopted Resolution No. 8969 to change the name of Elm Avenue to Carlsbad Village Drive. Despite the formal name change, there has remained a number of references to “Elm Avenue” within the Carlsbad Municipal Code. With the Municipal Code now on-line, the City Attorney’s Office has conducted a word search for those sections of the Code that contain the phrase “Elm Avenue.” The attached Ordinance updates those sections of the Code that still reference “Elm Avenue” and replaces them with “Carlsbad Village Drive.” FISCAL IMPACT: There is no fiscal impact associated with the introduction or adoption of this Ordinance. ENVIRONMENTAL REVIEW: This technical cleanup amendment is a ministerial act, statutorily exempt from CEQA pursuant to Public Resources Code section 21080(b)(l). EXHIBITS: 1. NS-534 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, REPLACING REFERENCE TO “ELM AVENUE” WITH “CARLSBAD VILLAGE DRIVE” WHEREAS, on February 17, 1987, the City Council adopted Resolution No. 8969 changing the name of Elm Avenue to that of Carlsbad Village Drive; and WHEREAS, the Carisbad Municipal Code still contains reference to Elm Avenue; and WHEREAS, to reflect the name change of “Elm Avenue” to “Carlsbad Village Drive,” the City Council desires to amend certain sections of the Municipal Code. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That Section 1.20.010 of the Carlsbad Municipal Code is amended to read as follows: “1.20.010 Reaular meetincs. The city council shall hold regular meetings on the first four Tuesdays of each month at the hour of 6:00 p.m., in the council chambers at the City Hall, 1200 Cartsbad Village Drive, Carlsbad, or such other place to which a meeting is adjourned. If by reason of fire, flood or other emergency, it is unsafe to meet in the council chambers, the meetings may be held for the duration of the emergency at such other place as is designated by the mayor, or, if he should fail to act, by three members of the city council. When the day for any regular meeting falls on a legal holiday, such meeting shall be held at the same hour and place on the next succeeding day not a holiday or such other time as designated by the city council.” 3. That Section 10.24.020 of the Carlsbad Municipal Code is amended to read as follows: “10.24.020 Allev from Carlsbad Villaae Drive to Grand Avenue. That Section 10.28.070 of the Carlsbad Municipal Code is amended to read as follows: “10.28.070 Carlsbad Boulevard. Drivers shall stop where the following described streets intersect Carlsbad Boulevard: Acacia Avenue Beech Avenue Carlsbad Village Drive Ceder Avenue Cerezo Drive Cherry Avenue Chestnut Avenue Cypress Avenue Grand Avenue Hemlock Avenue Juniper Avenue Lincoln Street Manzano Drive Maple Avenue Mountain View Drive Ocean Street Pine Avenue Redwood Avenue Sequoia Avenue Shore Drive Sycamore Avenue a Tamarack Avenue Terramar Drive Tierra del Oro Street Walnut Avenue” 5. That Section 10.28.100 of the Carlsbad Municipal Code is amended to read ‘as follows: Drive: “10.28.100 Hiahland Drive. That Section 10.28.220 of the Carlsbad Municipal Code is amended to read as follows: “10.28.220 Carlsbad Villaae Drive. That Section 10.28.260 of the Carlsbad Municipal Code is amended to read as follows: Street: “10.28.260 Monroe Street. Drivers shall stop where the following described street intersects Monroe Cartsbad Village Drive.” 9. That Section 10.32.091 of the Carlsbad Municipal Code is amended to read as follows: “10.32.091 Truck routes-Streets desianated. The prohibition set forth in Section 10.32.090 shall not apply to the following streets and portions of streets which are designated and established truck routes, as follows: limits; (a) Carlsbad Boulevard from the northerly city limits to the southerly city Freeway; (b) Carisbad Village Drive from Carlsbad Boulevard east to Interstate 5 (c) Tamarack Avenue from Interstate 5 Freeway, west to Carlsbad Boulevard; (d) Cannon Road, from Interstate 5 Freeway to Carlsbad Boulevard; (e) Interstate 5 Freeway, northerly city limits to southerly city limits; (f) Palomar Airport Road from Carlsbad Boulevard to easterly city limits (by Carlsbad Raceway). (Portion of Palomar Airport Road is in county); (g) El Camino Real from northerly city limits to southerly city limits; (h) Repealed by Ord. 3216 § 1; (i) La Costa Avenue from the westerly city limits to El Camino Real; (j) Ranch0 Santa Fe Road from the southerly city limits to Olivenhain Road and from Questhaven Road to the northerly city limits; (k) Olivenhain Road from the westerly city limits to Ranch0 Santa Fe Road; (I) Ranch0 Santa Fe Road for one way northbound traffic only via the temporary truck bypass from Olivenhain Road to Questhaven Road.” 10. (b) Parking of vehicles is prohibited during all hours of the day and night on the southerly side of Carlsbad Village Drive. (1) Between Highland Drive and Valley Street; (2) Between Valley Street and Monroe Street.” 11. That Section 10.40.051 of the Carlsbad Municipal Code is amended to read as follows: “10.40.051 Parkina restricted on Monroe Street. There shall be no parking on both sides of Monroe Street from Carlsbad Village Drive to Marron Road.” 12. That Section 10.40.053 of the Carlsbad Municipal Code is amended to read as follows: “10.40.053 Parkina restricted on Carlsbad Villaae Drive. Parking of vehicles is prohibited during all hours of the day and night on both sides of Carlsbad Village Drive from Carlsbad Boulevard to its intersection with Pio Pica Drive.” 13. That Section 10.40.054 of the Carlsbad Municipal Code is amended to read as follows: “10.40.054 Parkina restricted on Dortion of Madison Street. Parking of vehicles is prohibited during all hours of the day and night on both sides of Madison Street between Carlsbad Village Drive and Grand Avenue where planter areas protrude into the streets.” 14. That Section 10.40.056 of the Carlsbad Municipal Code is amended to read as follows: “10.40.056 Parkina restricted on r>ortion of Roosevelt Street. Parking of vehicles is prohibited during all hours of the day and night on both sides of Roosevelt Street between Carlsbad Village Drive and Grand Avenue where planter areas protrude into the street.” Page 5 of 9 of Ordinance No. NS-534 1 15. That Section 10.40.059 of the Carlsbad Municipal Code is amended 2 to read as follows: 3 4 “I 0.40.059 Parkincl restricted to Tamarack Avenue. (a) There will no parking on both sides of Tamarack Avenue from Skyline Road to Carlsbad Village Drive. 5 6 7 (b) There will be no parking on the easterly side of Tamarack Avenue from Carlsbad Village Drive to Wilshire Avenue and no parking on the westerly side of Tamarack Avenue from Carlsbad Village Drive to a point one hundred seventy feet southerly of Wilshire Avenue.” a 16. That Section 10.40.080 of the Carlsbad Municipal Code is amended 9 to read as follows: 10 “10.40.080 Anale Darkinq. 11 12 9 8 QJWUJ 227 pg 13 iuo 0) S"I5f 14 c dGSS 9 * 2" 15 arm< ZWV)" B$i, p 16 482 E-5 l7 G la In accordance with Section 10.40.025, and when signs or markings are in place giving notice thereof, drivers of vehicles may stand or park a vehicle only as indicated by such marks or signs on the following streets or portions thereof: (1) On both sides of State Street commencing at the intersection of State Street and Grand Avenue and extending northward three hundred and twenty-five feet; (2) On both sides of State Street between the intersection of Carlsbad Village Drive and Grand Avenue; (3) Repealed by Ord. 3157 § 1; (4) On both sides of Grand Avenue between Roosevelt Street and State Street; 19 20 21 22 23 24 25 26 27 28 (5) On the north side of Grand Avenue between Washington Street and Cartsbad Boulevard. The city engineer shall eliminate such diagonal parking at such time as two-way average daily traffic on Grand Avenue exceeds six thousand vehicles per day; Street.” (6) On the northerly side of Grand Avenue from Ocean Street to Garfield 17. That Section 10.40.120 of the Carlsbad Municipal Code is amended to read as follows: “10.40.120 Bus zones. (a) The city traffic engineer is authorized to establish bus zones opposite curb space for the loading and unloading of buses of common carriers of passengers and to determine the location thereof subject to the directives and limitations set forth in this chapter. (c) No bus zone shall exceed eighty feet in length, except that when satisfactory evidence has been presented to the city traffic engineer showing the necessity therefor, the city traffic engineer may extend bus zones not to exceed a total length of one hundred and twenty-five feet. That Section 10.40.125 of the Carlsbad Municipal Code is amended to read as follows: “10.40.125 Parkina time limited in business districts. When authorized signs are in place giving notice thereof no person shall stop, stand or park any vehicle within a business district between the hours of seven a.m. and six p.m. of any day, except Sundays and holidays, for a period of time longer than two hours. No person shall stop, stand or park any vehicle for a period of time longer than two hours on both sides of Carlsbad Village Drive from the railroad crossing west to Carlsbad Boulevard; and from a point sixty feet south of Carlsbad Village Drive on the easterly side of Carlsbad Boulevard to the intersection of Carlsbad Boulevard and Lincoln Street, and thirty feet south on the easterly side of Lincoln Street.” 19. That Section 10.40.126 of the Carlsbad Municipal Code is amended to read as follows: “10.40.126 Parkina time limited in business district. When authorized signs are in place giving notice thereof, no person shall stop, stand or park any vehicle within a business district between the hours of seven a.m. and six p.m. of any day, for a period of time longer than two hours. No person shall stop, stand or park any vehicle for a period of time longer than two hours on the westerly side of Carlsbad Boulevard between Grand Avenue and Carlsbad Village Drive.” I 20. That Section 10.40.130 of the Carlsbad Municipal Code is amended to read as follows: “10.40.130 Overniaht Darkina. It is unlawful for any person to park or leave parked any automobile or other vehicle between the hours of three a.m. to five a.m. on the hereinafter described streets: Drive; (1) On State Street between Oak Avenue and Laguna Drive; (2) On Roosevelt Street between Oak Avenue and Grand Avenue; (3) On Carlsbad Boulevard between Grand Avenue and Carlsbad Village (4) On Grand Avenue between Roosevelt Street and Carlsbad Boulevard; (5) On Carlsbad Village Drive between U.S. Freeway 101 and Carlsbad Boulevard. The traffic safety engineer and the maintenance director are instructed to erect signs giving notice of the provisions of this section.” 21. That Section 10.44.150 of the Carlsbad Municipal’Code is amended to read as follows “10.44.150 Monroe Street. (a) Upon Monroe Street from Carlsbad Village Drive to its intersection with Marron Road, the prima facie speed limit shall be forty-five miles per hour.” SECTION 21: That reference to “Elm Avenue” be replaced with “Carlsbad Village Drive” wherever it appears in the index of Chapters 10.24, 10.28, and 10.32.” EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and the City Clerk shall certify the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption.
