ENG I I Cl1 II OF CARLSBAD -AGENDA t,CL TITLE- ACCEPTING BIDS AND AWARDING A CONTRACT --%R THE WIDENING OF PALOMAR AIRPORT ROAD FROM EL CAMINO REAL TO MELROSE DRIVE, PROJECT NO. 3602; APPROVAL OF PLANS AND SPECIFICATIONS FOR PALOMAR AIRPORT ROAD AND EL CAMINO REAL TURN LANES AND APPROVING A CONTRACT CHANGE ORDER TO C x STELLO, INC., FOR CONSTRUCTION OF THESE IMPROVEMENTS. PROJECT NO. 3676 RECOMMENDED ACTION: Adopt Resolution No. $000 -‘?b accepting bids and awarding a contract to Castello Inc., for the widening of Palomar Airport Road from El Camino Real easterly to Melrose Drive, Project No. 3602; approving plans and specifications, prepared by Berryman & Henigar, for Palomar Airport Road and El Camino Real turn lanes and approving a contract change order to Castello, Inc., for construction of these improvements, Project No. 3676. ITEM EXPLANATION: On August 17, 1999, the City Council approved the plans and specifications and authorized the advertisement for bids for the widening of Palomar Airport Road from El Camino Real easterly to Melrose Drive. Eastbound Palomar Airport Road is being widened to full prime arterial standards from El Camino Real easterly to Melrose Drive except for median landscaping and irrigation, sidewalks and streetlights on the south side, which will be required when the frontage is developed. Construction will add a third eastbound lane and an additional left-turn lane, eastbound on Palomar Airport Road to northbound at the El Fuerte Street intersection. On October 14, 1999, twelve sealed bids were received ranging from $719,565 to $981,376. Hanson SJH Construction (formerly Sim J. Harris Construction) was the low bidder. The City received a formal letter of bid protest on October 21, 1999 from the second low bidder, Southland Paving, addressing two alleged errors in the bid from the low bidder Hanson SJH Construction and protesting the award of the contract to Hanson SJH Construction. On November 16, 1999, the City Council rejected all bids and authorized the re-advertisement for new bids. The Engineer’s Estimate for this project was $626,321 after deleting the work to construct a l&inch water line stub-out to the Lennar-Bressi Ranch. On February 1, 2000, the Purchasing Department received fifteen sealed bids as shown below. The City received bids from all but one (Granite Construction) of the original twelve bidders and from four new bidders. Paving $820,744.40 Sean Malek Engineering $841,188.50 Wier Construction $862,894.50 ABC Construction $895,318.60 Scheidel Contracting $997,472.00 Page 2 of Agenda Bill No. - Castello, Inc., who was also an original bidder, is a general engineering contractor who has constructed other projects for the City in the past including the recent widening of Palomar Airport Road from El Camino Real westerly to Yarrow Drive. Staff has reviewed the information submitted in the bid package and recommends the award of the contract for Project No. 3602 to Castello, Inc. Berryman & Henigar have completed the plans and specifications for an additional right-turn lane at both the northeast and southeast corner of the intersection of Palomar Airport Road and El Camino Real. One right-turn lane is on the westbound/north side of Palomar Airport Road on approach to El Camino Real. The other right-turn lane is on the northbound/east side of El Camino Real on approach to Palomar Airport Road. Single right-turn lanes currently exist in these two locations. Project No. 3676 will result in a dual right-turn lane configuration. The additional turn lanes will be 13 feet wide, approximately 250 feet in length, and will be accommodated within the existing public right-of-way. Staff recommends that the City Council approve the plans and specifications and approve negotiation and execution of a contract change order for Castello, Inc. to construct the improvements for the following reasons. This additional work is within the scope of the project and adjacent to the site of the work, but was not contemplated when plans and specifications were originally prepared for the widening of Palomar Airport Road, Project No. 3602. The two additional right-turn lanes will implement the City’s Growth Management policies, improve traffic flow and enhance public safety and convenience. The City received very good, competitive bids on Project No. 3602, and use of the same contractor for construction of these two right-turn lanes will result in substantial cost savings since the estimated cost of approximately $150,000 is less than the previous appropriation for the additional work. ENVIRONMENTAL REVIEW: The potential impacts have been reviewed consistent with CEQA. Project No. 3602 was determined to be within the scope of the environmental analysis for PCD/GPC 90-5. A Mitigated Negative Declaration (EIA 91-14) was issued for PCD/GPC 90-5 and the Planning Director has issued a notice of prior compliance on June IO, 1999. A Negative Declaration (EIA 99-02) was issued pursuant to the provisions of CEQA for construction of the two right-turn lanes, Project No. 3676, and the Planning Director filed a Notice of Determination on January 28, 2000. FISCAL IMPACT: The following is an estimate of the of the total costs for these projects: Project No. 3602 has an existing appropriation from TransNetILocal funds in the amount of $610,000. The City Council made an additional appropriation of $590,000 on November 16, 1999 from the General Capital Construction fund. Therefore, sufficient funds are available to complete Project No. 3602. Page 3 of Agenda Bill No. /-z 6 bb An agreement entered into on July 15, 1992 between the City and Bank of America National Trust and Savings Association, as Trustee of the Mary E. Bressi Trust (dated June 2, 1988) requires the Lennar-Bressi Ranch to reimburse the City for the cost of the third east bound lane at such time as they develop their property. The exact amount of the reimbursement will be calculated once the construction for Project No. 3602 is complete and the final costs are determined. The right-of-way that is required for this project has been valued at $31,000. The property owner, Lennar-Bressi Ranch, has signed the right-of-way documents in exchange for extending existing utility sleeves and replacing the majority of asphalt berm, located on the south side of the road, with concrete curb and gutter. The bid amount from Castello, Inc. for these items of work equals $50,354 and therefore exceeds the value of the right-of-way by $19,354. Lennar-Bressi Ranch has provided a check to the City in the amount of $19,354 for this difference in cost. Project No. 3676 has an existing appropriation of $1 ,OQO,OOO from the LFMP Zone Transportation fund. This fund was established in 1999 with a $1 million loan from the GCC fund, to be repaid once sufficient developer fees have been collected. To date, developer’s have paid approximately $158,000. FOR CONSTRUCTION OF THESE IMPROVEMENTS. PROJECT 3676. WHEREAS, the City Council of the City of Carlsbad has previously authorized the advertisement for bids for the widening of Palomar Airport Road from El Camino Real to Melrose Drive, Project No. 3602; and WHEREAS, the City Council does hereby find that Project No. 3602 is in prior compliance with Mitigated Negative Declaration EIA 91-14; and WHEREAS, fifteen (15) sealed bids were received on February 1, 2000 by the City of Carlsbad for the widening of Palomar Airport Road, iroject No. 3602; and WHEREAS, all bid documents received from all bidders have been reviewed in detail and the City Council does hereby find that the lowest responsible bidder, Castello, Inc., did submit a bid in the amount of $629,156.00; and WHEREAS, the City Council does hereby find that Project 3676 is in compliance with Negative Declaration EIA 99-02; and WHEREAS, the City Council finds that the Negative Declaration (EIA 99-02) which was prepared and published reflects the independent judgment of the City Council of the City of Carlsbad; and WHEREAS, plans and specifications for the construction of an additional right-turn lane at both the northeast and southeast corner of the intersection of Palomar Airport Road and El Camino Real, Project No. 3676 have been prepared and are on file in the Engineering Department of the City of Carlsbad and are incorporated by reference herein; and WHEREAS, the City Council of the City of Carlsbad finds it in the public interest to negotiate and execute a change order with the contractor, Castello, Inc. for the addition of right-turn lanes at Palomar Airport Road and El Camino Real; and 1 ,’ - . ^/-.. 3 . 1 WHEREAS, the City Council of the City of Carlsbad has previously appropriated the funds 2 for this project; and 3 WHEREAS, Subsection 3.28.172(d)(l) of the Carlsbad Municipal Code authorizes the 4 City Manager to approve change orders in the amount set at the time of the bid award; and 5 WHEREAS, the City Council of the City of Carlsbad, California, hereby declares it 6 necessary, desirable and in the public interest to construct the aforementioned project. 7 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 8 California, as follows: 9 1. That the above recitations are true and correct. 10 2. That the bid of $629,156.00 as ‘determined by extension of the unit prices 11 submitted by Castello, Inc. of Escondido, California for Project 3602, for widening of 12 Palomar Airport Road, is hereby accepted and the Mayor and City Clerk are hereby authorized 13 and directed to execute a contract therefor. 14 3. That the plans and specifications for Project 3676 are approved. 15 4.
