PLN RECOMMENDED ACTION: CT 98-20 CITY MGR = That the City Council hear the request to exempt the project known as James Canyon Estates from the Urgency Ordinance prohibiting the issuance of building and/or grading permits for projects processed under Titles20 or 21 of the Carlsbad Municipal Code, located within the area known as “Olde Carlsbad”. ITEM EXPLANATION: On November 2, 1999, the City Council took action to adopt an urgency ordinance (NS-516) establishing a moratorium on the issuance of grading and/or building permits for all projects processed under Title 20 or 21 of the Carlsbad Municipal Code and located within the area known as “Olde Carlsbad”. The action included a process whereby a project applicant may be granted an exemption from the moratorium if the proposed street improvements associated with the project are compatible with surrounding properties and the area, and the applicant agrees to install the improvements. The property owner for the project identified as James Canyon Estates and, as shown on the attached location map, and described below has submitted a written request to be placed on the agenda to address Council regarding exempting the project from the moratorium. DESCRIPTION OF PROJECT: This project which is located in the northwest quadrant at the southern terminus of James Drive between Hillside Drive and Park Drive in the R-l (One Family Residential) zone, consists of the subdivision- and grading of a 4.28 acre parcel into 12 standard single family lots. Existing infrastructure and public utilities serve the project from James Drive, a local public street that currently terminates at the project’s northern boundary. The proposed grading necessitates 17,000 cubic yards of import to create building pads for 12 single family lots ranging in size from 7,809 square feet to 22,688 square feet in area. One and two-story single family homes are proposed and two of the units will have second dwelling units to satisfy the project’s inclusionary housing requirement. The proposed subdivision and grading design would extend James Drive approximately 650 feet to the south where it will terminate as a cul-de-sac. James Drive will provide access to 8 of the 12 proposed lots. A second, very short cul-de-sac street that intersects with the James Drive extension will provide access to four lots in the northwestern portion of the site. No access proposed from Hillside Drive due to traffic safety concerns. EXHIBITS: 1. Location Map 2. Letter request from Property Owner. . . James Canyon Estates CT 98-20 Request for Grading & Building Permit Exemption Dear Mr. Orenyak: This letter serves as notice of request for a grading and building permit exemption for the above referenced project. The basis of this request is as follows; The construction of the James Drive extension from its existing street end through the new development will not have any impact on existing trees or roadways. The James Drive extension is through undeveloped land. Hillside Drive, app. 525 ft. in length, borders the west side of the subdivision. To allow for the required street widening and sidewalk improvements would he of minimal impact to the existing roadway. For the total length of the road improvements there are possibly three trees that may have to be removed to allow for the street improvements. 1 would appreciate if you could review and process this request for exemption.
