RECOMMENDED ACTION:
Adopt Resolution No. 2000-104 accepting bids and awarding Project No. 3618 for the construction of Carlsbad Boulevard Parking at Ponto Beach Road Reconstruction to Southland Paving, Inc.
ITEM EXPLANATION:
On November 9, 1999, City Council authorized the advertisement for bids for the construction of the Carlsbad Boulevard Parking at Ponto Beach Road Reconstruction, Project No. 3618. The Purchasing Department received twelve (12) sealed tiids on February 3, 2000 and are shown in Table 1.

This project will provide for the construction of parallel vehicular parking along the west side of Carlsbad Boulevard from the Batiquitos Lagoon Bridge to approximately 800 feet northerly thereof. Dedicated parking stalls will not be provided, however, the new improvements will accommodate approximately 31 vehicles.
*The bid documents submitted by Southland Paving, Inc., were reviewed by staff and found to be in order with the following exception: In two cases, the written bid amounts for bid items did not agree with the numeric amount shown for that bid item. Therefore, in accordance with the provisions of the bid instructions wherein the written amount takes precedence, Southland Paving, Inc.% bid of $54,950.00 has been reduced to $48,445.85. Staff recommends that the City Council award the contract for the Carlsbad Boulevard Parking at Ponto Beach Road Reconstruction, Project No. 3618, to Southland Paving, Inc., in the amount of $48,445.85. Should Southland Paving fail to execute the contract within the specified time, staff recommends Council authorizes administrative award of this contract by the City Manager to the next lowest bidder.
ENVIRONMENTAL:
The Planning Director has determined that the project is in conformance with the City’s General Plan. The project is a minor addition of street surface improvements. The project is categorically
exempt pursuant to the provisions of Section15301 (c) of the Guidelines for the California
Environmental Quality Act. The Planning Commission approved Coastal Development Permit
(CDP 98-77) August 18, 1999.

FISCAL IMPACT:
Funds have been appropriated for this project. Sufficient Gas Tax funds are available for the construction of this project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AUTHORIZING
THE EXECUTION OF CONTRACT NO. 3618 FOR THE
CONSTRUCTION OF CARLSBAD BOULEVARD PARKING AT
PONTO BEACH ROAD RECONSTRUCTION, PROJECT NO. 3618.
WHEREAS, plans have been reviewed by the City Council of the City of Carlsbad for
the construction of Carlsbad Boulevard Parking at Ponto Beach Road Reconstruction,
7 Project No. 3618; and
8 WHEREAS, bids have been received by the City of Carlsbad for the construction of said
9 project; and
10 WHEREAS, the low bid received to construct said project was submitted by Southland
11 Paving, Inc., in the amount of $48,445.85; and
12 WHEREAS, the low bid received to construct said project submitted by Southland Paving,
,3 Inc., is responsive; and
14 WHEREAS, the total estimated costs for said project are $118,245.85; and
WHEREAS, Council has previously appropriated $150,000.00 for design, construction,
15 administration and inspection of said project; and

WHEREAS, funds are available from Gas Tax Revenues.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
I8 California, as follows:
19 1. That the above recitations are true and correct.
20 2. That the bid of $48,445.85 by Southland Paving, Inc., for Project No. 3618 for
21 construction of Carlsbad Boulevard Parking at Ponto Beach Project is accepted, and the Mayor is
22 hereby authorized to execute a contract therefor.
23 3. That the Finance Director is authorized to appropriate funds to the project account
24 from the Gas Tax Fund.
4. 25 That the City Manager is hereby authorized to approve construction change
orders up to $20,000.

1 5. That the award of this contract is contingent upon the contractor executing the
2 required contract and submitting the required bonds and insurance policies, as described in the
3 contract, within twenty (20) days of adoption of this resolution. The City Manager may grant
reasonable extensions of time. 4
6. That should Southland Paving, Inc., not execute the contract, Council authorizes 5
the City Manager to determine the disposition of the bid bond and administratively award the
6 contract to the second lowest bidder. If the second lowest bidder fails or refuses to execute the
7 contract, the City Manager is likewise authorized to award the contract to the third lowest bidder.

9 PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
