Construction Company for Curb Gutter and Sidewalk Replacement in accordance with Contract No. STS99-00-01. ITEM EXPLANATION: Due to aging infrastructure, it becomes necessary to replace sections of curb gutter and sidewalk as it becomes cracked and/or raised to reduce trip hazards, and thus liability, throughout the City. Staff conducted an inventory and identified those areas most in need of repair or replacement in this year’s contract. No trees will be impacted in the completion of this contract. On December 14, 1999, City Council approved contract documents and special provisions, and authorized the City Clerk to advertise for bids for Curb Gutter & Sidewalk Replacement, Contract No. STS99-00-01. Eight bids were received, opened, witnessed and recorded on February 7, 1999. The bids were reviewed by the staff of the Purchasing Department and Street Maintenance Division. Bighorn Construction Company Inc. submitted the lowest bid. Therefore, staff recommends the contract be awarded to Bighorn Construction Company inc., the lowest responsive bidder, in the amount of $84,811.50. The contractor’s registration and bonds are in order and references are satisfactory. Contract documents are on file in the Public Works/Street Maintenance Division office. FISCAL IMPACT: Including a 15% contingency ($12,721.73), the total project cost is $97,533.23. Funding is available in the Major Street Maintenance budget (80%) and Transnet Local Sidewalk Construction Project No. 6 (20%). EXHIBITS: 1. STS99- 00-01 FOR CURB GUlTER & SIDEWALK REPLACEMENT WHEREAS, bids have been received by the City of Carlsbad, California for Curb Gutter & Sidewalk Replacement Contract No. STS99-00-01; and, WHEREAS, the lowest responsive bid received was submitted by Bighorn Construction Company Inc. in the amount of $84,811.50; and, WHEREAS, sufficient funds are available in the Major Street Maintenance budget (80%) and Transnet Local Sidewalk Construction Project No. 6 (20%); and WHEREAS, the award of this contract is contingent upon the contractor executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty days of adoption of this resolution. The City Manager may grant reasonable extensions of time; and, WHEREAS, if the contractor fails to comply with the insurance and bonding requirements in the prescribed time, the City Council authorizes an administrative award of this contract to the second ‘or third lowest bidder. The bid security of the lowest bidder may be forfeited. On the failure of the second or third lowest bidder to whom this contract is awarded to execute it, the bidder’s security may likewise be forfeited. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. The above recitations are true and correct. 2.
