RECOMMENDED ACTION:
Introduce Ordinance No.ds-53r amending Carlsbad Municipal Code Chapter 10.42 to add
a section establishing a special enforcement unit for the purpose of enforcing state and local
disabled parking laws.
ITEM EXPLANATION:
Vehicle Code section 22507.9 authorizes the City Council to establish a special enforcement
unit for the purpose of enforcing state and local disabled parking laws. Though disabled
parking laws can be and are enforced by police officers, community service officers, and a
parking enforcement officer, the Police Department would also like to utilize Senior Volunteer
Patrol members for these enforcement activities. In order to do this, the Senior Volunteer
Patrol members must be part of a special enforcement unit established in accordance with
the above Vehicle Code section.
FISCAL IMPACT:
No fiscal impact is anticipated as the creation of the unit will not require the purchase of new
equipment and the unit will be comprised of volunteers.
ENVIRONMENTAL REVIEW:
Pursuant to Public Resources Code section 21065 and CEQA Guidelines section 15378, this
amendment does not constitute a “project” within the meaning of CEQA and, therefore, does
not require environmental review.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, TO AMEND CHAPTER
10.42 OF THE CARLSBAD MUNICIPAL CODE TO ADD A
SECTION ESTABLISHING A SPECIAL ENFORCEMENT
UNIT FOR THE PURPOSE OF ENFORCING STATE AND
LOCAL DISABLED PARKING LAWS
follows:
The City Council of the City of Carlsbad, California, does ordain as
SECTION I: That Chapter 10.42 of the Carlsbad Municipal Code is
amended by the addition of the following section:
“10.42.020 Soecial enforcement unit for disabled Darking
violations.
A special enforcement unit is established for the enforcement of violations
of state and local disabled parking laws. The members of the special enforcement unit
shall be volunteers of the police department and shall be designated by the chief of
police, subject to the requirements of California Vehicle Code section 22507.9. The
chief of police shall also determine the equipment and uniforms to be issued to
members of the unit, subject’to the requirements of California Vehicle Code section
22507.9.
Nothing in this section shall preclude City police officers or authorized City
employees from engaging in similar enforcement activities.”
EFFECTIVE DATE: This ordinance shall be effective thirty days after its
adoption and the City Clerk shall certify the adoption of this ordinance and cause it to
be published at least once in a newspaper of general circulation in the City of Carfsbad
within fifteen days after its adoption.

Council on the 11 th day of April ,2000, and thereafter
