REQUEST FOR EXEMPTION FROM
MTG. 5-9-00 MORATORIUM IN “OLDE CARLSBAD” FOR
SEAVIEW g-LOT SUBDIVISION

RECOMMENDED ACTION:
That the City Council hear the request to exempt the project known as Seaview g-Lot Subdivision
from the Urgency Ordinance prohibiting the issuance of building and/or grading permits for projects
processed under Titles 20 or 21 of the Carlsbad Municipal Code, located within the area known as
“Olde Carlsbad”.
ITEM EXPLANATION:
On November 2, 1999, the City Council took action to adopt an urgency ordinance (NS-516)
establishing a moratorium on the issuance of grading and/or building permits for all projects
processed under Title 20 or 21 of the Carlsbad Municipal Code and located within the area known
as “Olde Carlsbad”. The action included a process whereby a project applicant may be granted an
exemption from the moratorium if the proposed street improvements associated with the project are
compatible with surrounding properties and the area, and the applicant agrees to install the
improvements.
The property owner for the project identified as Seaview g-Lot Subdivision and, as shown on the
attached location map, and described below has submitted a written request to be placed on the
agenda to address Council regarding exempting the project from the moratorium.
DESCRIPTION OF PROJECT:
This project which is located in the northwest quadrant at the northern terminus of Seaview Way,
north of Chestnut Avenue in the R-1-10,000 (One Family Residential) zone, consists of the
subdivision and grading of a 3.96 acre parcel into 9 standard single family lots. Existing
infrastructure and public utilities serve the project from Seaview Way, a local public street that
currently terminates at the project’s southern boundary. The proposed grading of 18,993 cubic
yards is a balanced cut and fill operation and will create building pads for 9 single family lots ranging
in size from 11,887 square feet to 21,373 square feet in area. Two-story single family homes are
proposed and two of the units will have second dwelling units to satisfy the project’s inclusionary
housing requirement. The proposed subdivision and grading design would extend Seaview Way to
the north and then east for a distance of approximately 320 feet where it will terminate as a cul-de-
sac. All of the lots will be accessed via Seaview Way. The proposed curb, gutter, and sidewalk
would be a continuation of the curb, gutter, and sidewalk which currently exists along both sides of
Seaview Way.

RE: Seaview
Dear Mayor and Council Members:
With the completion of the Street and Sidewalk Report by the Committee and its
presentation to the City Council on March 7’h the Seaview, LLC requests the g-lot
Seaview project, located at the terminus of Seaview be released from the
moratorium. The Seaview project and street were excluded from the
Committee’s review and discussion. The report does not comment nor mention
Seaview as an alternative design street. The street plans that have been
prepared are in and ready for third plan check approval. They complete Seaview
to full City standards, consistent with the street improvements that previously
existed on Seaview.
Therefore, since the Committee did not consider Seaview and there are no
changes (either recommended or contemplated from the standard City
improvements) it’s our request Seaview be removed from the moratorium.
Commencement of this project would have no affect on the Committee’s report
nor the implementing ordinances that will flow from the Committee’s report, as
accepted by the Council. The approval of Seaview, as designed, will not affect
any determination, based upon the Committee and staffs actions.
