RECOMMENDED ACTION:
Introduce Ordinance No. NS-543 amending the Carlsbad Municipal Code to designate
NO PARKING from 11:OO p.m. to 500 a.m. on the easterly side of the southbound lane of Carlsbad Boulevard from Palomar Airport Road to a point 535 feet south of Palomar Airport Road.

ITEM EXPLANATION:
The Carlsbad Police Department has experienced problems when automobiles or recreation
vehicles park overnight on the easterly side of the southbound lane of Carlsbad Boulevard from
Palomar Airport Road to a point 535 feet south of Palomar Airport Road. Occupants of these
vehicles sometimes use the beach late at night which leads to problems such as vandalism or
loud parties or it generates citizen complaints. Rangers from the State of California Parks and
Recreation Department have also complained of late night use of the beach after closure of beach
hours. In the subject location for consideration of the parking restriction, City maintenance crews have reported illegal waste dumpingdnto the storm drain system.
To prohibit overnight parking, the Police Department requested a night restriction on parking,
similar to other locations along Carlsbad Boulevard and consistent with other portions of the
Carlsbad Municipal Code. At their April 3, 2000 meeting, the Traffic Safety Commission
recommended, by a 3-O vote, that a parking prohibition from 11:OO p.m. to 5:00 a.m. be
established on the easterly side of the southbound lane of Carlsbad Boulevard beginning at
Palomar Airport Road and continuing to a point 535 feet southerly of Palomar Airport Road.
I FISCAL IMPACT:
Eight new NO PARKING signs with time restrictions mounted on telspar posts will cost about
$1,200 to manufacture and install.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER
10.40 OF THE CARLSBAD MUNICIPAL CODE BY THE
REVISION OF SECTION 10.40.041 TO ESTABLISH NO
PARKING FROM 11:OO P.M. TO 5:00 A.M. ON THE EASTERLY
SIDE OFTHE SOUTHBOUND LANE OF CARLSBAD BOULEVARD FROM PALOMAR AIRPORT ROAD TO A POINT
535 FEET SOUTHERLY OF PALOMAR AIRPORT ROAD.
7 The City Council of the City of Carlsbad, California, hereby ordains as follows:
8 SECTION 1: That Title IO, Chapter 10.40 of the Carlsbad Municipal Code is amended by
9 the addition of Section 10.40.041 (b)(5) to read as follows:
10 “(5) On the easterly side of the southbound lane of Carisbad
Boulevard from Palomar Airport Road to a point 535 feet
11 southerly of Palomar Airport Road there will be no parking between 11:OO p.m. and 5:00 a.m.”
12 EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption
I3 and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to
I4 be published at least once in a newspaper of general circulation in the City of Carlsbad within
15 fifteen (15) days after its adoption.
16 INTRODUCED AND FIRST READ at a regular meeting of said City Council held on the
17 9th day of May (2000, and thereafter,
16 PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 19 day of ,200O by the following vote, to wit:
