ENG CITY MGR. RECOMMENDED ACTION: Adopt Resolution No. am-179 summarily vacating a portion of Chestnut Avenue east of Garfield Street. ITEM EXPLANATION: On February 1, 1999, an application was filed with the City requesting the vacation of a portion of Chestnut Avenue just east of Garfield Street, Currently Chestnut Avenue has an 80-ft right-of-way width. At this location Chestnut is designated as a local street. Since the standard right-of-way width for a local street is 60 feet, the 80-ft width is excessive. As proposed, the street vacation will have no effect on the ultimate curb-to-curb width of the street. Chestnut Avenue at this location will ultimately consist of a 60-e right-of-way width with a 40-ft curb-to-curb width. East of Garfield Avenue to Carlsbad Boulevard, Chestnut will remain at an 80-foot right-of-way width with a 60-foot curb-to-curb width. This is consistent with the traffic patterns adjacent to Carlsbad Boulevard and does not present any circulation problems. Staff has reviewed the application and has concluded that the excess right-of-way width is not required for present or future street purposes. The requested vacation does not affect traffic circulation and does not change street parking availability. The street vacation is considered to be of a minor nature and consistent with previously approved street vacations in the same general location. The utility companies have been notified of this street vacation request. Pacific Bell has responded that they have facilities in the area and requested the reservation of an easement for these facilities. Therefore, a public utility easement will be reserved on the area being vacated. FISCAL IMPACT: Approval of this street vacation will result in approximately 888 square feet of land to be returned to the tax rolls. While no detailed economic analysis was conducted, there will be an increase in tax revenue resulting from development of this area. EXHIBITS: 1. Location Map. 2. That pursuant to Chapter 4, Part 3, Division 9 of the California Street and 19 20 Highways Code, said excess right-of-way more particularly described in Exhibit A, and shown for 21 the sake of clarity in Exhibit B, be summarily vacated. 3. 22 That easements and rights necessary to maintain, operate, replace, remove, or 23 renew in-place public facilities are reserved and excepted from the vacation. 4. 24 The City Clerk is directed to record this resolution in the office of the County 25 Recorder of San Diego County. 26 "I 27 "' 28 'If C 2816 1 5.
