RECOMMENDED ACTION:
Introduce Ordinance No. N S -5 ao establish a prima facie 35 mile per hour speed limit upon
Windrose Circle from Avenida Encinas to Navigator Circle (S)/Capstan Drive.
ITEM EXPLANATION:
The Board of Directors for San Pacifico Area “A” initiated a request to have a prima facie speed
limit established on Windrose Circle. Although residential housing has developed adjacent to
Windrose Circle, the road does not qualify as a Residence District according to the requirements
set forth by the California Vehicle Code.
Windrose Circle is unclassified on the Circulation Element of the General Plan. It is a four-lane
roadway built to city standards with curb and gutter, sidewalks, street lights and bicycle lanes.
The subject segment is 0.28 miles in length and has an Average Daily Traffic (ADT) volume of
1,900 vehicles. There have been no reported accidents on Windrose Circle in the past two years.
Sections 22357 and 22358 of the California Vehicle Code authorizes local authorities to establish a prima facie speed limit on the basis of the results of an Engineering and Traffic Survey.
The Engineering and Traffic Survey considers such factors as the number of collisions that have
occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic
volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight
distance, and conditions that may not be readily apparent to the driver.
At their meeting on May 1, 2000, the Traffic Safety Commission considered the results of the
Engineering and Traffic Survey to establish a prima facie speed limit upon Windrose Circle. The
Commission recommended by a 4-O vote to establish a 35 mile per hour prima facie speed limit
upon Windrose Circle from Avenida Encinas to Navigator Circle (S)/Capstan Drive.
The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic Engineer.
FISCAL IMPACT:
Installing two speed limit signs on Windrose Circle between Avenida Encinas and Navigator
Circle (S)/Capstan Drive will cost about $250.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER
10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE
ADDITION OF SECTION 10.44.650 TO ESTABLISH A PRIMA
FACIE 35 MILE PER HOUR SPEED LIMIT UPON WINDROSE
CIRCLE FROM AVENIDA ENCINAS TO ITS INTERSECTION
WITH NAVIGATOR CIRCLE (SKAPSTAN DRIVE.
The City Council of the City of Carlsbad, California, hereby ordains as follows:
SECTION 1: That Title 10, Chapter 10.44 of the Carlsbad Municipal Code is amended
by the addition of Section 10.44.650 to read as follows:
“10.44.650 Windrose Circle: Upon Windrose Circle from
Avenida Encinas to its intersection with Navigator Circle
(S)/Capstan Drive the prima facie speed limit shall be thirty-five
miles per hour.”
EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption
and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to
be published at least once in a newspaper of general circulation in the City of Carlsbad within
fifteen (15) days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of said City Council held on the
13 th day of tune, 2000, and thereafter,
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the day of (2000 by the following vote, to wit:
