That the City Council ADOPT Resolution No. 2000-197 APPROVING the Amendment No.
2 to the agreement Professional Services Agreement for building inspection services for various
projects under construction within the City of Carlsbad, and making an appropriation transfer.
ITEM EXPLANATION:
The City uses a mix of full time, part time, and contract building inspection services. Building
inspection request levels continue their strong pace. The contract for building inspectors, hired
through Kleinfelder and Associates was set at $125,000. This contract was administratively
amended recently to allow a contact increase of $31,250. An additional $68,750 is necessary to pay
for two contract building inspectors for the entire year. The original contract allowed for Kleinfelder
and Associates to provide one inspector to the City. Kleinfelder and Associates is currently provrding
two inspectors to the City. This is anticipated to continue for the fiscal year
2000-01. The contract will have a maximum of $225,000 upon Council approval.
FISCAL IMPACT:
There is adequate funding for Miscellaneous Professional Services in the Building Department
budget for the remainder of fiscal year 1999-00. The proposed budget for fiscal year 2000-01 aso
has adequate funding for Miscellaneous Professional Services Account in the Building Department
will be utilized to pay for contract inspection services on an as-needed basis. No additionat budget
action is required for this contract amendment.
ENVIRONMENTAL:
The Planning Director has determined that the activities that are the scope of the contract are
categorically exempt from CEQA review pursuant to Section 15309 of the CEQA Guidelines. A
Notice of Exemption will be filed upon approval of the contract.

RESOLUTION NO. 2000-197
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF CARLSBAD, CALIFORNIA, APPROVING AN
AMENDED AGREEMENT BETWEEN THE CITY OF
CARLSBAD AND KLEINFELDER, INCORPORATED FOR
BUILDING INSPECTION.
WHEREAS, the City Council of the City of Carlsbad has determined it necessary,
desirable and in the public interest to provide building inspection services as an element of the
construction process for projects under construction within the City of Carlsbad; and
WHEREAS, staff has determined that two contract field inspectors are required to meet
the demand for field inspection services: and
WHEREAS, the current amended contract with Kleinfelder and Associates Incorporated
has a contract limit of $156,250; and
WHEREAS; staff has determined that the contract limit must be raised an additional
$68,750 to provide two field inspectors for an entire fiscal year;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California as follows:
1. That the above recitations are true and correct
2. That the amended Agreement for Professional Services between the City of Carlsbad
and Kleinfelder, Incorporated to provide building inspection services is approved, and the Mayor
and City Clerk are authorized and directed to execute the same on behalf of the City.

AMENDMENT NO. 2 TO AGREEMENT FOR PROFESSIONAL SERVICES
This Amendment is entered into and effective as of the 27th day of
June ,2000, amending the agreement dated September 18,1998 by and between
the City of Carlsbad, a municipal corporation, hereinafter referred to as “City”, and
KLEINFELDER, INC., hereinafter referred to as, “Contractor” for the services of an inspection
services contractor to provide the necessary inspections for construction projects within the
City.
RECITALS
WHEREAS, the initial agreement, dated September 18, 1998 identified a scope
of work for inspections for various projects being constructed on an as-needed basis and as
directed by the Principal Building Inspector or designated representatives; and
WHEREAS, the parties to this aforementioned agreement desire to alter the
scope of work to allow for additional services for construction inspections; and
WHEREAS, a supplemental scope of work and fee schedule have been
negotiated and agreed to between the parties hereto;
NOW, THEREFORE, in consideration of these recitals and the mutual covenants
contained herein, City and Contractor hereby agree as follows:
1. Contractor shall provide services for construction inspections on an as-
needed basis.
2. City shall pay Contractor for all work associated with Paragraph 1 above, on
a time and materials basis not-to-exceed $68,750 and for each extension hereafter of the
original contract. Contractor shall provide City on a monthly basis, copies of invoices
sufficiently detailed to include hours performed, hourly rates, and related activities and costs for
approval by City.

3. Contractor shall complete all work as designated by the Principal Building
Inspector by expiration of the agreement amended hereby.
4. All other provisions of the aforementioned agreement entered into on
September 18, 1998, by and between City and Contractor shall remain in full force and effect.
5. All requisite insurance policies to be maintained by the Contractor shall
include coverage for the amended assignment and scope of work.
