HomeMy WebLinkAbout2000-07-11; City Council; 15825; Employer Paid Member Contributionsj’1.-.--\ CIP OF CARLSBAD - AGEWA BILL !,“‘7’i ,,; 2 j, ,-+I RATIFICATION OF CURRENT PRACTICE CONCERNIN EMPLOYER PAID MEMBER CONTRIBUTIONS (EPMC) RECOMMENDED ACTION: Adopt Resolution No. m - dgto implement Government Code Section 2069 1 which provides that the normal member contributions to the California Public Employees’ Retirement System (CalPERS) be paid by the employer. ITEM EXPLANATION: The City of Carlsbad is a member agency participating in the California Public Employees’ Retirement System (CalPERS). Two separate retirement contributions are made to CalPERS on behalf of an employee - employee contributions and City contributions. The City is responsible for paying all of the City contribution. In 1980 legislation was passed to allow agencies to pay all or a portion of the employees contribution. Over time, the City of Carlsbad negotiated this benefit with its employee associations and management employees and agreed to pay all of the employee contributions for each of its employee groups according to the following table: Date EPMC Employee Association Implemented Percentage Carlsbad City Employees’ Association 05/25/l 98 1 7% Carlsbad Police Officers’ Association 07/01/1982 9% Carlsbad Firefighters’ Association 09/21/1987 9% Management Employees 06/07/1981 7% At the time the above agreements were negotiated, no Resolution was required. CalPERS has since changed their requirements; therefore, a formal Resolution needs to be on file to formalize the current practice. This resolution is to formalize the agreements reached with the above groups of employees. This resolution does not add, delete or change any of the Memoranda Of Understanding already in effect, nor does it change any provisions of the current Management Compensation Plan. Resolution No. &C0 4 3.c d 5 8 . 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 RESOLUTION NO. 2000-235 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, IMPLEMENTING GOVERNMENT CODE SECTION 20691 WHICH PROVIDES THAT THE NORMAL MEMBER CONTRIBUTIONS TO THE CALIFORNIA PUBLIC EMPLOYEES’ RETIREMENT SYSTEM (CALPERS) BE PAID BY THE EMPLOYER. WHEREAS, the City Council has the authority to implement Government Code Section 20691; WHEREAS, the City Council has written agreements with its employee associations and management employees which specifically provide for the normal member contributions to be paid by the City; WHEREAS, one of the steps in the procedures to implement Section 20691 is the adoption by the City Council of a Resolution to commence said Employer Paid Member Contributions (EPMC); and WHEREAS, the City Council has identified the following conditions for the purpose of its election to pay EPMC: l This benefit shall apply to all employees in the following employee groups and this benefit shall consist of paying the related percentages of the normal member contributions as EPMC as noted next to each of the employee groups: Employee Association EPMC Percentage Carlsbad City Employees’ Association 7% Carlsbad Police Officers’ Association 9% Carlsbad Firefighters’ Association 9% Management Employees 7% l The effective date of the Resolution shall be July 18, 2000. 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. That the above recitations are true and correct. 2. That no amendments are needed to existing employee contracts. 3. That the City Council wishes to comply with Section 20691 by adopting this resolution. 4. That the City Council elects to pay Employer Paid Member Contributions (EPMC), as set forth above. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council, held on this 18th day of JULY ,2000, by the following vote, to wit: AYES: Council Members Lewis, Hall, Finnila, Nygaard and Kulchin NOES: None ABSENT: None ATTEST: 7 (SEAL) 3
