DEPT. HR CLAIM OF DANIEL ROY
3ECOMMENDED ACTION:
Approval of Resolution No. &%-a,+/ approving the Stipulations with Request for
Award, which authorizes the payment of $30,047.50 to Daniel Roy.
ITEM EXPLANATION:
The claimant is a former Equipment Operator with the City of Carlsbad Public Works
Department. He was hired by the City in October 1977.
Mr. Roy sustained an industrial injury to his lumbar spine as a result of swinging a
sledgehammer.
The Stipulations with Request for Award (on file in the Human Resources Department) is
based on the disability rating provided by the State of California, Office of Benefit
Determination and recommended by TRISTAR, the City’s third party administrator.
FISCAL IMPACT:
The cost of the settlement is $30,047.50 payable at the rate of $170.00 weekly and the
provision of future medical treatment. There are sufficient funds available in the Workers’
Compensation Self-Insurance Fund to cover the cost of this settlement.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CALRSBAD, CALIFORNIA, AUTHORIZING THE EXPENDITURE OF
FUNDS FOR SETTLEMENT OF THE WORKERS’ COMPENSATION
CLAIM OF DANIEL ROY
WHEREAS, TRISTAR, Third Party administrator for the City of Carlsbad has
5 recommended a settlement of the Workers’ Compensation claim of Daniel Roy; and
6 WHEREAS, there are sufficient funds available in the Workers’ Compensation Self-
7 Insurance Fund to pay the settlement.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
10 Carlsbad, California, as follows:
11 1. That the above recitations are true and correct.
12 2. That the expenditure of $30,047.50 from the Workers’ Compensation Self-
13 Insurance Fund is authorized for the settlement of said claim.
14 3. That the City Council accepts the Stipulations with Request for Award on file in
15 the Human Resources Department.
