That the City Council hear the request to exempt the project known as Carlsbad Beach Estates 5-lot subdivision from the Urgency Ordinance prohibiting the issuance of building and/or grading permits
for projects processed under Titles 20 or 21 of the Carlsbad Municipal Code, located within the area
known as “Olde Carlsbad”.
ITEM EXPLANATION:
On November 2, 1999, the City Council took action to adopt an urgency ordinance (NS-516)
establishing a moratorium on the issuance of grading and/or building permits for all projects
processed under Title 20 or 21 of the Carlsbad Municipal Code and located within the area known as
“Olde Carlsbad”. The action included a process whereby a project applicant may be granted an
exemption from the moratorium if the proposed street improvements associated with the project are
compatible with surrounding properties and the area, and the applicant agrees to install the
improvements.
The property owner for the project identified as Carlsbad Beach Estates, as shown on the attached location map, and described below has submitted a written request to be placed on the agenda to
address Council regarding exempting the project from the moratorium.
DESCRIPTION OF PROJECT:
This project which is located in the northwest quadrant on the south side of Chinquapin Avenue just
east of Garfield Street in the RD-M (Residential Density-Multiple) zone, consists of the subdivision
and grading of a 1 .I 13-acre parcel into 5 lots (4 single-family detached lots and 1 condominium lot). Existing infrastructure and public utilities serve the project from Chinquapin Avenue, a local public
street that fronts the projects northern boundary. The proposed grading of 281 cubic yards of cut, 2,824 cubic yards of fill, and 2,543 cubic yards of import will create building pads for 5 lots ranging in
size from 3,780 to 6,930 square feet (for single family detached units) and 29,580 square feet (for the
condominium units). Two-story homes are proposed and one of the single-family detached units will
have a second dwelling unit to satisfy the project’s inclusionary housing requirement. (Payment of a
fee will complete the inclusionary housing requirement for the project.) All of the lots will be
accessed via Chinquapin Avenue.

Dear Mayor and Council Members:
Carlsbad Beach Group Investors, LLC, request the 5 lot subdivision (CT99-01) has been or
should be released from “Old Carlsbad” moratorium (NS-516) for the following reasons:
I. The tentative map was approved by the Planning Commission on March 15, 2000.
There was no condition placed on permits regarding the “Old Carlsbad Moratorium”.
The project was approved because it conforms to, and enhances, the residential
neighborhood. Chinquapin Avenue is a fully developed street, including City
standard concrete curbs and sidewalks, from Garfield Avenue (800 feet +I-) east to
the railroad tracks, where it terminates. There are no future needs or plans to change
the current street improvements.
II. The City’s street and sidewalk Report Committee made it’s presentation to the City
Council on March 7. 2000. The Carlsbad Beach Estates Project CT 99-01 was
excluded from the Committee’s review and discussion. Since this portion of
Chinquapin Avenue is fully developed with concrete curbs and sidewalks and
according to table 1 of the report, is listed as a compatible improvement, and is
consistent with current City standards or compatible in width and configuration with
improvements already installed in the block. Therefore, since the Committee did not
consider Carlsbad Beach Estates and there are no changes, (either recommended or
contemplated for this section of Chinquapin Avenue from the standard city
improvements in place), our project is, or should be exempt from the moratorium.
III. We are H. David Buckmaster and Patricia A. Buckmaster, principals of Carlsbad
Beach Group Investors, LLC with approximately 85% of our net worth comprised of
this project. We currently reside at 265 Chinquapin Avenue and we plan to make this
area our permanent home. Any delays will place an unfair hardship on our financial
well being. Commencement of this project would have no affect on the Committee’s
report nor the implementing ordinances that will flow from the Committee’s report, as
accepted by the Council. The approval of issuance of permits, as designed, will not
affect any determination, based upon the Committee and staffs actions.
Based on all the above, we hope that our project is exempt. If it is determined that a public
hearing is required, we request to be placed on the earliest possible City Council meeting.
