1 RECOMMENDED ACTION:
Adopt Resolution No. %@)-dY 9 approving the final map for Carlsbad Tract CT 98-20 James
Canyon Estates, and authorizing the City Clerk to process the map for recordation.
I ITEM EXPLANATION:
Engineering staff has completed checking the final map of Carlsbad Tract CT 98-20, known as
James Canyon Estates. This subdivision is within Local Facilities Management Plan (LFMP) Zone 1
and is generally located at the southern terminus of James Drive. The project is comprised of 12
proposed residential lots.
The final map conforms substantially with the tentative map as approved by Planning Commission
on November 17, 1999, per PC Resolution No. 4663. The final map also conforms to the General
Plan, all the applicable requirements of the Municipal Code, City Standards, and Growth
Management Plan. The applicant, Hall Investment Company, a California Corporation, is requesting
the recordation of said final map.
On November 2, 1999, the City Council took two actions: 1) To adopt an urgency ordinance (NS-
516) establishing a moratorium on the issuance of grading and/or building permits for all projects
processed under title 20 or 21 of the Carlsbad Municipal Code and located within “Olde Carlsbad”.
2) To adopt Resolution 99-484 restricting the removal of trees within public right-of-way located
within “Olde Carlsbad”. This project is located within “Olde Carlsbad”, and is subject to these
moratoriums.
Regarding the first moratorium, CT 98-20 involves the construction of three public streets know as:
1. Hillside Drive
2. James Drive
3. Tara Court.
Hillside Drive is the only street identified as an Alternative Street per the Street and Sidewalk Policy
Committee. However, CT 98-20 was originally conditioned to construct Hillside Drive to public
standards, and the improvements plans include full pavement, curb, gutter, and sidewalk. In order
to proceed with construction, the property owner has submitted a request for exemption from the
City Council regarding the moratorium. Staff supports the applicant’s request as the project
conforms to the approved Tentative Map and the conditions of approval of the tract map. If this
project is exempted, issuing the Grading Permits will also allow a window of opportunity for the
applicant to complete grading before the rainy season this year (October 1).
Regarding the second moratorium, there are two existing trees located along Hillside Drive within
public right-of-way. The applicant has agreed to process a construction change to the improvement
drawings (drawing 387~5), to shift the Hillside Drive and avoid the removal of street trees. This
revision will avoid any conflicts with the moratorium.

FISCAL IMPACT:
The developer pays a plan check fee to cover the expense of plan checking and processing the final map for recording. There is no fiscal impact to the City. All appropriate fees will be paid if and when
building permits are issued for this project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE FINAL MAP FOR
CARLSBAD TRACT CT 98-20 JAMES CANYON ESTATES
AND AUTHORIZING THE CITY CLERK TO PROCESS THE
MAP FOR RECORDATION.
WHEREAS, Hall Investment Company, a California Corporation has submitted a final
map known as Carlsbad Tract CT 98-20 James Canyon Estates to the City of Carlsbad for
approval; and
WHEREAS, the tentative map of Carlsbad Tract CT 98-20 with conditions, was approved
by Planning Commission on November 17, 1999, per PC Resolution No. 4663; and
WHEREAS, the Public Works Director has determined that said map substantially
conforms to said conditionally approved tentative map; and
WHEREAS, the conditions of approval for said final map have been completed or
secured; and
WHEREAS, the developer has offered public easements for dedication to the City of
Carlsbad; and
WHEREAS, the final map conforms to the City of Carlsbad General Plan and all
requirements of City Codes and Standards; and
WHEREAS, the City Council of the City of Carlsbad determined it to be in the public
interest to approve said final map; and
WHEREAS, on November 2, 1999, the City Council took action to adopt an urgency
ordinance establishing a moratorium on the issuance of grading and/or building permits for all
projects processed under Title 20 and 21 of the Carlsbad Municipal Code and located within “Olde
Carlsbad”, and
WHEREAS, the urgency ordinance included a process whereby the project applicant could
be granted an exemption from the moratorium upon written request from the applicant, and/or
property owner; and
WHEREAS, a written request has been submitted for the project known as CT 98-20,
James Canyon Estates, and
WHEREAS, on August 1, 2000, the City Council considered said request for exemption, all
information provided by the applicant, and/or property owners as well as any other interested
persons providing testimony.

1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
2’ California, as follows:
3 1. That the above recitations are true and correct.
2. 4 That said final map known as Carlsbad Tract CT 98-20 James Canyon Estates,
which is on file with the Public Works Director and is incorporated herein by reference, is 5
accepted.
6 3. That the City accepts the dedications shown on the final map.
7 4. That the City Clerk is authorized to sign the Certificate of Acceptance on the
8 final map.
9 5. That the City Clerk is authorized to cause the original final map to be recorded in
10 the Office of the County Recorder of San Diego County, State of California.
11 6. That the City Clerk is authorized to release the map to First American Title
12 Insurance Company for recording in the Office of the County Recorder.
13 7. That the City Council approves the request for exemption from the moratorium as it
14 (I relates to CT 98-20, James Canyon Estates.
15 II PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
16 held on the 1st day of Ausust , 2000 by the following vote, to wit:
