That the City Council ADOPT Resolution No. do00 -2 ‘?s APPROPRIATING all funds plus
interest for the Calavera Heights Mitigation Preserve Fund for pres&ve management activities.
ITEM EXPLANATION:
The Calavera Nature Preserve is a 110 acre mitigation parcel located south of, and adjacent to, Lake
Calavera on the eastern edge of the Calavera Hills Master Plan. It was acquired by the previous
master plan owners (Lyon Communities) as mitigation in order to allow the development of Villages
Q and T to proceed. Those villages are currently being developed by McMillin and Brookfield.
Formal title transfers for the Nature Preserve occurred in November 1998 when the City Council
accepted title from the developer, and then transferred title to the designated environmental
manager, The Environmental Trust (Agenda Bill #I 4,943, November 17, 1998). The Environmental
Trust then initiated management activities on the Preserve consistent with the site’s Management
Plan.
As outlined in the agenda bill of November 17, 1998, $93,875 was posted by the original developer
for short term management purposes. At this time, TET is invoicing the City $11 ,I 30 (copy attached)
for management activities (fencing, signage, trash removal, materials and initial trail restoration) that
occurred from November 1998 until present. Future reimbursement requests by TET will be
reviewed by the Planning and Finance Departments.
Per the terms of the 1993 Agreement between the master plan property owners and the City, the
originally deposited $93,875 amount is designated for short-term management activities subject to
approval by the Planning Director. The timeframe to expend these funds is the first five years of
management, or between November 1998 and November 2003. Also per the 1993 Agreement,
between years two and four (2000-2002), TET, the city and the master plan property owner shall
collectively devise a long term management plan designed to adequately preserve the site into
perpetuity. The effort has not been initiated yet but will begin by early next year, 2001.
ENVIRONMENTAL:
The on-going management of the Calavera Nature Preserve and related financial reimbursement by
the City will not create any adverse impacts to the environment. The appropriation of funds for
preserve management is not subject to the California Environmental Quality Act (CEQA).
FISCAL IMPACT:
There will be no direct fiscal impacts to the City other than a minor amount of staff time for
administrative oversight and support to TET to adequately implement the terms of the 1993
Agreement. The funds being expended were deposited by the previous Calavera Hills Master Plan
property owner for the purpose of maintaining the mitigation parcel. The current available balance,
including interest earnings, is approximately $140,000.

MITIGATION PRESERVE FUND FOR MANAGEMENT
ACTIVITIES.
CASE NAME: CALAVERA NATURE PRESERVE

WHEREAS, on March 15, 1993, the City and Lyon Communities entered into a
Mitigation Agreement whereby a II 0 acre parcel was purchased for the purpose of permanent
open space and habitat preservation to mitigate the impacts of development of Villages Q and T
within the Calavera Hills Master Plan; and
WHEREAS, the Mitigation Agreement calls for short term management of the
110 acre parcel utilizing funds submitted by Lyon Communities; and
WHEREAS, the amount of funds contained in the designated Calavera Heights
Mitigation Preserve Fund total $93,875 plus interest accrued since the date of deposit; and
WHEREAS, the designated environmental manager for this preserve, The
Environmental Trust (TET), has satisfactorily performed initial preserve management activities;
and
WHEREAS, TET has submitted a request to the city for reimbursement of the
costs of the activities performed from the funds deposited by Lyon Communities.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad as follows:
1. That the above recitations are true and correct.
2. That the appropriation of all funds plus interest from the Calavera Heights
Mitigation Preserve Fund is authorized.
3. That the Planning Director and Finance Director are hereby authorized to
make future reimbursement payments to TET as appropriate until all funds plus interest have
been expended for the management of the Calavera Nature Preserve.

Enclosure (1) is the original invoice from The Environmental Trust for work performed
on the Calaveras Nature Preserve. This invoice covers the period from transfer of the
land to The Environmental Trust until the present, i.e. 23 November 1998 through 30
June 2000. It is inclusive of all work done during that period in support of the Calaveras
Nature Preserve Management Plan, dated February 1,1998.
Enclosure (2) is our plan for fences and guardrails for various sections along the top of
the quarry. For reasons of liability and safety, we are recommending fencing that goes
well beyond that recommended in the management plan, i.e. barbed wire. Because the
City of Carlsbad does intend to include Calaveras Mountain within its open-space trail
system and has the right of approval on final trail designation, we would appreciate your
comments and concurrence with these plans prior to implementation.
Due to the complexities of this project, I believe it is in our mutual best interests to work
closely on this project. On that basis, I will be calling you soon to set up a briefing
meeting to go over our plans for fencing, trail restoration, etc.
