ADDITIONAL PARKING FOR 2075 LAS PALMAS DRIVE
RECOMMENDED ACTION:
Approve Resolution No.;7&- 3 ;;I @,uhorizing the Mayor to execute all documents associated with
the purchase and transfer of interest in 19,400 square feet of property from Hawthorne Family Trust
to the City of Carlsbad, and appropriating $165,800 from the General Capital Construction Fund
balance for the purchase of said property and payment of associated fees.
ITEM EXPLANATION:
The City of Carlsbad is the owner of real property located at 2075 Las Palmas Drive, APN 213-061-
19, formally known as the Community Development Building. Beginning in 1986, the City
negotiated an easement agreement with the developer/owner of the adjacent property, APN 213-061-
20, for development and use of a portion of that property for parking that would be allocated to the
Community Development Building in order to meet the City’s parking standard. In 1987, APN 213-
061-20 was purchase by Hawthorne Family Trust and a new easement agreement signed with the
City. Per the agreement, a portion of the parking lot would be shared, with termination of the parking
easement occurring at such time as the City discontinued its “use and exclusive occupancy” of 2075
Las Palmas Drive.
In January 2000, the Community Development Building was vacated by City staff, but continued to
be use for storage of City property. On March 14,2000, the City Council authorized staff to offer for
lease the Community Development Building, and to negotiate a lot line adjustment, easement, and
purchase agreement with Hawthorne Family Trust, the adjacent property owner, for acquisition of a
portion of the shared parking lot. On August 3, 2000, Mr. J.T. Hawthorne, representing Hawthorne
Family Trust agreed to a lot line adjustment and purchase price of $8.50 per square foot for 19,400
square feet of the parking lot (Exhibit 2).
On August 2, 2000, the Carlsbad Planning Commission approved the finding of consistency with the
General Plan. In addition, the lot line adjustment and easement documents have been prepared and
property markers set. Staff is recommending that City Council allocate $164,900 for the purchase of
the property and $900 in escrow fees from the General Capital Construction Fund balance, and
authorized the Mayor to execute all necessary documents associated with lot line adjustment,
easement and transfer of the property to City ownership.
FISCAL IMPACT:
Allocation of $165,800 from the General Capital Construction Fund balance to purchase 19,400
square feet of property for the purposes of providing permanent parking for 2075 Las Palmas Drive
will permit the continued use of the building as an office or research and development building and
enhance the overall utility and monetary value of the building.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AUTHORIZING THE MAYOR TO
EXECUTE ALL DOCUMENTS ASSOCIATED WITH THE
PURCHASE AND TRANSFER OF INTEREST IN A PORTION
OF APN 213-061-20 FROM HAWTHORNE FAMILY TRUST
AND APPROPRIATING FUNDS FOR PURCHASE AND
PAYMENT OF FEES ASSOCIATED WITH THE PROPERTY.
WHEREAS, the City Council of the City of Carlsbad has determined that it is in the best
interest of the City to acquire a portion of the property used as parking for 2075 Las Palmas
Drive from the current owner, Hawthorne Family Trust; and
WHEREAS, the City Council has further determined that it accepts the agreed purchase
price of $8.50 per square foot for 19,400 square feet of real property, for a total purchase price of
$164,900; and
WHEREAS, the Carlsbad Planning Commission at its meeting of August 2,200O
determined that acquisition of the property is consistent with the Carlsbad General Plan; and
WHEREAS, an adjustment plat, easement and related documents have been prepared for
APN 213-061-19 and APN 213-061-20.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California as follows:

1. That the above recitations are true and correct.
2. That the Mayor is authorized to execute all documents associated with the
purchase and transfer of interest in 19,400 square feet of property from
Hawthorne Family Trust to the City of Carlsbad.
3. That an appropriation of $ 164,900 for purchase of the property is authorized
from the General Capital Construction Fund balance.
4. That an appropriation of $900 for Escrow Fees is authorized from the
General Capital Construction Fund balance

Dear Mrs. Haas:
This letter is to respond to your correspondence dated July 7,200O. I have been in
contact with Fraser Engineering regarding the lot line adjustment of Lots 4 and 5 of Carlsbad
Tract No. 80-33. We have an appointment with Mr. Ross to physically observe the survey stakes
he had indicated in the plot plan for lot line adjustment. We are in agreement in principal to go
forward with the plan and do not anticipate any change in the lot line adjustments as drawn, but I
do want to physically observe them before final documents are drawn for recording.
I am in agreement with your calculation of the transfer of our property of approximately
19,400 sq. A. at an acceptable sales price of $8.50 per square foot. The only other contingency
would be the approval of the easement or access agreement that will be drawn and mutually
agreed upon as part of this sale.
I hope this letter is satisfactory for your staff to draw the necessary documents to go
forward for presentation to the City Council.
