PUBLIC HEARING FOR LOCAL LAW

RECOMMENDED ACTION:
1. City Council schedule a public hearing regarding the proposed use of Department of Justice Local
Law Enforcement Block Grant funds to support various police department functions.
ITEM EXPLANATION:
The City of Carlsbad’s application for funding under the US Department of Justice’s Local Law
Enforcement Block Grants Program from the Omnibus Fiscal Year 1999 Appropriations Act was
approved in the amount of $86,331.
These one-time funds can be used only to enhance, and not replace, law enforcement budgets and
must be spent within two years from the receipt of the grant. The federal funds may not exceed 90
percent of the total program costs. The City must provide at least 10 percent of the total program
cost in cash. It is recommended that these matching funds come from the police asset forfeiture
fund. In addition, any interest earned must be added to the project and spent for project purposes.
With a block grant award of $86,331, the cash match must be $9,592; estimated interest is $4,000
for a total program-funding amount of $99,923 for eligible projects/programs.
The police department is requesting that the following appropriations totaling $99,923 be made: Live
Scan equipment ($60,000), North County drug court support ($10,000) alternate light source for
evidence processing ($lO,OOO), simunition equipment ($6,000) North County Gang Task Force
support ($5,000), community report ($3,000) and citizens academy ($1,923) plus an additional
$4,000 from interest earned for miscellaneous related expenses. These proposed expenditures
comply with the requirements of the grant.
As required by the regulations for the funding, an advisory committee must make recommendations
to the City Council on the projects proposed for funding under the subject block grant. The Carlsbad
Advisory Board met on February 1, 2000, and recommended City Council approval of staffs
proposed expenditures.
A public hearing must be held regarding the proposed use of the funds and must be held prior to the
obligation of the funds. Staff is recommending that the City Council accept public testimony on the
proposed expenditures as explained above. If the proposed expenditures areacceptable, staff then
recommends that the City Council approve the attached resolution accepting the funding and
appropriating funds to the projects noted above.
FISCAL IMPACT:
The total program cost is $99,923; $86,331 would come from the block grant award. The required
cash match of $9,592 would be appropriated from the police asset forfeiture fund. An additional
$4,000 is estimated for interest earned.

Notice of Public Hearing
The citizens of Carlsbad are hereby notified that Carlsbad’s City Council will
hold a public hearing on Tuesday, NOVEMBER 14, 2000 at 6 p.m. in the Council
Chambers located at 1200 Carlsbad Village Drive to accept public comments
and consider for approval: 1) the acceptance of US Department of Justice
Local Law Enforcement Block Grant funds; and, 2) appropriating the funds to
support various law enforcement functions.
