Adopt Resolution No. doaz356 authorization to advertise to receive construction bids and
approval of additional appropriation for the Seawall Stairway Repair Project No. 35191.
ITEM EXPLANATION:
The Seawall Stairway Repair, Project No. 35191, will replace all of the concrete treads at the
staircase near lifeguard tower #8 between Sycamore and Chestnut Avenues. The concrete treads
are worn and cracked and should be replaced to maintain the stairway in a safe condition.
The design of the stairway repair project has been completed so that the City can advertise for bids
and construct the project during the winter months.
ENVIRONMENTAL REVIEW:
The City has secured a Minor Coastal Development Permit (CDP 00-49) dated October 24, 2000.
This project is categorically EXEMPT from environmental review per Section 15302 (Class 2) of the
California Environmental Quality Act which exempts the replacement or reconstruction of facilities
with similar materials.
FISCAL IMPACT:
Currently, the miscellaneous beach access stairway account has an available balance of $32,000.
The Seawall Stairway Repair Project No. 35191 has an estimated cost of $52,000, therefore, staff
recommends that additional funding of $20,000 be appropriated from the City’s General Capital
Construction Fund in order to fully fund this stairway repair project.

WHEREAS, additional funds in the amount of $20,000 are required and available to fund
the Seawall Stairway Repair Project No. 35191; and
WHEREAS, staff has prepared plans and specifications for the Seawall Stairway Repair,
Project No. 35191, and staff recommends that the City advertise to receive bids for construction.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That the additional appropriation of $20,000 is hereby approved and the
Finance Director is hereby authorized to appropriate $20,000 from the City’s General Capital
Construction Fund.
3. That the City Clerk is hereby authorized to advertise to receive bids for
construction of the Seawall Stairway Repair Project No. 35191.

SUBJECT: CDP 00-49 - SEAWALL STAIRWAY REPAIR
The City has completed a review of the application for a Minor Coastal Development
Permit for the Seawall Stairway Repair Project. This project consists of replacing the
stairsteps on the existing beach access stairway just north of Chestnut Avenue.
It is the Planning Director’s determination that the project request for the replacement of
the stairway steps located on the bluff west of Carlsbad Boulevard, CDP 0049, is
consistent with the applicable City’s Coastal Development Regulations (Chapters
21.201 - 21.205) and with all other applicable City ordinances and policies. The
Planning Director, therefore, APPROVES this request based upon the following:

That the total cost of the proposed development is less than $60,000 based on
the cost estimates provided.
That the proposed development requires no discretionary approvals other than a
Minor Coastal Development Permit; the repair of facilities located within fifty
feet of the edge of a coastal bluff in the coastal zone is considered
“development” and therefore requires a coastal permit.
That the development has no adverse effect individually or cumulatively on
coastal resources or public access to the shoreline or the coast, in that no
coastal resources or opportunities for coastal access are available from the
subject site; the project will replace stairsteps on an existing stairway in
order to protect public health, safety and welfare and improve the public’s
access up and down the bluff and to the shoreline.
That the proposed development is in conformance with the Mello II Certified
Local Coastal Program and all applicable policies in that the site is designated
foropenspaceandbeachaccessuses.

5. That the development is in conformity with the public access and public
recreation policies of Chapter 3 of the Coastal Act, in that existing beach
access stairways at the specific, subject location are deteriorating and are
in need of replacement which will increase public safety.
6. That this request for a minor coastal development permit was adequately noticed
at least fifteen (15) working days before the date of this decision pursuant to
Section 21.201.080(B) and (C) of the Carlsbad Coastal Development Permit
Procedures Ordinance.
7. That the Planning Director has determined that the project will not have a
significant effect on the environment since it is categorically exempt from
environmental review per Section 15302 (Class 2) of the California
Environmental Quality Act (CEQA). Class 2 exempts the replacement or
reconstruction of facilities located on the same site with substantially the same
purpose and capacity as the replaced structure. The proposed stairstep
replacement project qualifies for this exemption.
8. This project is consistent with the General Plan and has received a finding
of General Plan consistency as made with the list of Capital Improvement
Projects by the Planning Commission on May 17, 1999.
Conditions:
1. The Planning Director does hereby APPROVE the Minor Coastal Development
Permit, CDP 00-49, for the project entitled “Seawall Stairway Repair“. (Exhibits
“A-B”), dated October 24, 2000, on file in the Planning Department and
incorporated by this reference, subject to the conditions herein set forth. Staff is
authorized and directed to make, or require the Developer to make, all
corrections and modifications to the Minor Coastal Development Permit
documents, as necessary to make them internally consistent and in conformity
with the final action on the project. Development shall occur substantially as
shown on the approved Exhibits. Any proposed development substantially
different from this approval, shall require an amendment to this approval.
2. If any of the following conditions fail to occur; or if they are, by their terms, to be
implemented and maintained over time, if any of such conditions fail to be so
implemented and maintained according to their terms, the City shall have the
right to revoke or modify all approvals herein granted; deny or further condition
issuance of all future building permits; deny, revoke or further condition all
certificates of occupancy issued under the authority of approvals herein granted;
institute and prosecute litigation to compel their compliance with said conditions
or seek damages for their violation. No vested rights are gained by Developer or
a successor in interest by the City’s approval of this CDP 00-49.

3. The Developer shall comply with all applicable provisions of federal, state, and
local ordinances in effect at the time of building permit issuance.
4. The Developer/Operator shall and does hereby agree to indemnify, protect,
defend and hold harmless the City of Carlsbad, its Council members, officers,
employees, agents, and representatives, from and against any and all liabilities,
losses, damages, demands, claims and costs, including court costs and
attorney’s fees incurred by the City arising, directly or indirectly, from (a) City’s
approval and issuance of this Minor Coastal Development Permit, (b) City’s
approval or issuance of any permit or action, whether discretionary or non-
discretionary, in connection with the use contemplated herein, and (c)
Developer/Operator’s installation and operation of the landscaping permitted
herein.
5. The effective date for this project shall be after City and Coastal
Commission appeal periods have been exhausted.
