ESTABLISH A PRIMA FACIE SPEED LIMIT MTG. 12/05/00 UPON A PORTION OF CANNON ROAD
I RECOMMENDED ACTION:
Introduce Ordinance No. &T--C; 6cl\ to establish a prima facie 45 mile per hour speed limit upon
Cannon Road from Paseo Del Norte to Faraday Avenue.
ITEM EXPLANATION:
Cannon Road is designated as a major arterial on the Circulation Element of the General Plan and has a design speed of 50 miles per hour. On July 26, 2000 Cannon Road was opened to traffic
between LEGOLAND Drive and Faraday Avenue. The portion of Cannon Road from Paseo Del
Norte to LEGOLAND Drive has been used by the traveling public for a number of years and has a
posted speed limit of 40 miles per hour.
Over the years, land uses along this corridor have changed, traffic volumes have increased and as a result, critical speeds have increased. Speed surveys indicate critical speeds of 47 miles per
hour and 50 miles per hour in several locations along Cannon Road from Paseo Del Norte to
Faraday Avenue. Cannon Road is a four-lane divided roadway built to City standards.
Sections 22357 and 22358 of the California Vehicle Code authorizes local authorities to establish a prima facie speed limit on the basis of the results of an Engineering and Traffic Survey.
The Engineering and Traffic Survey considers such factors as the number of collisions that have occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic
volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight
distance, and conditions that may not be readily apparent to the driver.
At their meeting on October 2, 2000, the Traffic Safety Commission considered the results of the Engineering and Traffic Survey to establish a prima facie speed limit upon a portion of Cannon
Road. The Commission recommended by a 3-O vote to establish a 45 mile per hour prima facie
speed limit upon Cannon Road from Paseo Del Norte to Faraday Avenue, thereby raising the
existing 40 mile per hour speed limit between Paseo Del Notte and LEGOLAND Drive.
The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic
Engineer.

FISCAL IMPACT:
Installing eight speed limit signs on Cannon Road between Paseo Del Norte and Faraday Avenue
will cost about $1,000.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44,
OF THE CARLSBAD MUNICIPAL CODE BY THE AMENDMENT OF
SECTION 1044.380 TO ESTABLISH A PRIMA FACIE 45 MILE PER
HOUR SPEED LIMIT UPON CANNON ROAD FROM PASEO DEL
NORTE TO ITS INTERSECTION WITH FARADAY AVENUE.
6 The City Council of the City of Carlsbad, California, hereby ordains as follows:
7 SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended
s by the revision of Section 10.44.380 to read as follows:
9 “1044.380 Cannon Road:
a. 10 Upon Cannon Road from Carlsbad Boulevard to its intersection with Paseo Del Norte, the prima facie speed limit shall
11 be thirty-five miles per hour.
b. 12 Upon Cannon Road from Paseo Del Norte to its intersection
with Faraday Avenue, the prima facie speed limit shall be forty-five

miles per hour.”
14 EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption
and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to
15 be published at least once in a newspaper of general circulation in the City of Carlsbad within
16 fifteen (15) days after its adoption.
17 INTRODUCED AND FIRST READ at a regular meeting of said City Council held on the
18 5th day of i, 2000, and thereafter,
19 PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
20 held on the day of ,200O by the following vote, to wit:
