CARLSBAD TRACT 89-13
THE HAMPTONS
RECOMMENDED ACTION:
Adopt Resolution No. aobr c 3 approving the final map for Carlsbad Tract CT 89-13, The
Hamptons, and authorizing the City Clerk to process the map for recording.
ITEM EXPLANATION:
Engineering staff has completed checking the final map of Carlsbad Tract CT 89-13, also known as
The Hamptons. This is a 8.212-acre property subdivided for residential development. This
subdivision is within Local Facilities Management Plan (LFMP) Zone #I and is generally located
south of Park Drive between Marina & Bayshore Drives. It is comprised of one (1) lot with uses as
follows: 42 condominium units.
The final map conforms substantially with the tentative map as approved by Planning Commission
on February 21, 1990 per Resolution No. 2983, and with the modified conditions pursuant to City
Council Resolution No. 90-80 of March 27, 1990 denying an appeal and upholding the Planning
Commission’s decision. The map also conforms to all additional conditions pursuant to tentative
map extensions granted per City Council Resolutions No. 92-244 on August 4, 1992 and No. 93-
137 on May 18, 1993, and per Planning Commission Resolution No. 4246 on April 1. 1998. The
final map also conforms to the General Plan, all the applicable requirements of the Municipal Code,
City Standards, and Growth Management Plan. The applicants, Mary Ferrero, successor trustee of
the Nino and Lea Ferrer0 Family Trust, and Jack N. Spirtos and Penelope Spirtos, trustees under
an April 13, 1984 trust agreement, are requesting the recordation of said final map.
FISCAL IMPACT:
The developer pays a plancheck fee to cover the expense of planchecking and processing the final
map for recording. There is no fiscal impact to the City. All appropriate fees will be paid if and
when building permits are issued for this project.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, APPROVING THE FINAL MAP FOR
CARLSBAD TRACT 89-l 3, THE HAMPTONS, AND 4 AUTHORIZING THE CITY CLERK TO PROCESS THE MAP FOR
RECORDING.

WHEREAS, Mary Ferrero, successor trustee of the Nino and Lea Ferrer0 Family Trust,
and Jack N. Spirtos and Penelope Spirtos,, trustees under an April 13, 1984 trust agreement,
8 have submitted a final map known as Carlsbad Tract 89-13 to the City of Carlsbad for approval;
9 and
10 WHEREAS, the tentative map of Carlsbad Tract 89-13 with conditions, was approved by
II the Planning Commission on February 21, 1990, pursuant to Resolution No. 2983; and
12 WHEREAS, the City Council did on March 27, 1990 after hearing an appeal of the
13 Planning Commission’s decision, adopt Resolution No. 90-80 approving the tentative map; and
14 WHEREAS, the City Council did on August 4, 1992 per Resolution No. 92-244 and again
,5 on May 18, 1993 per Resolution No. 93-l 37 grant one year extensions of the tentative map; and
16 WHEREAS, the State of California granted a two year extension and a one year
17 extension to all active tentative maps; and
18 WHEREAS, the Planning Commission did on April 1, 1998 per Resolution No. 4246 grant
a two year extension of the tentative map; and

WHEREAS, the Public Works Director has determined that said map substantially
conforms to said conditionally approved tentative map; and
21 WHEREAS, the conditions of approval for said final map have been completed or
22 secured; and
23 WHEREAS, the developer has offered public street and public easements for dedication
24 I( to the City of Carlsbad; and

WHEREAS, the final map conforms to the City of Carlsbad General Plan and all
requirements of City Codes and Standards; and
27 WHEREAS, the City Council of the City of Carlsbad determined it to be in the public
28 interest to approve said final map; and

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That said final map known as Carlsbad Tract 89-13, The Hamptons, which is on
Rle with the Public Works Director and is incorporated herein by reference, is accepted.
3. That the City accepts the dedications shown on the final map..
4. That the City Clerk is authorized to sign the Certificate of Acceptance on the final
map.
5. That the City Clerk is authorized to cause the original final map to be recorded in
ihe Office of the County Recorder of San Diego County, State of California.
6. That the City Clerk is authorized to release the map to Chicago Title Company for
?ecording in the Office of the County Recorder.
