ITEM EXPLANATION: The City Attorney’s Office requests that a new classification of Legal Assistant be created to recognize the additional paralegal responsibilities assigned to the position of Legal Secretary and that the Legal Secretary position be reclassified to Legal Assistant. Recently, the current incumbent received her Paralegal Certificate and has since been assuming the responsibilities of a paralegal in supporting the attorneys’ work. Based on this added responsibility and higher level knowledge requirement, Human Resources recommends that this position be reclassified to Legal Assistant and placed in the General Employees’ Salary Schedule at range 56. The attached revised description of Legal Assistant (Attachment A) is submitted for Council’s consideration and review. This position combines both paralegal and legal secretarial responsibilities in support of the work in the City Attorney’s Office. Typical duties are to conduct legal research of state and federal case law, statutes and legislation, to prepare and review legal documents, e.g., contracts, agreements and citations for attorney approval, and to assist attorneys in coordinating the activities in the litigation of civil and criminal cases. The position also will continue to provide secretarial support to the attorneys, such as, preparing agenda bills, resolutions, correspondence, scheduling meetings and court dates and maintaining files and records. Although there is salary data available for legal secretaries and paralegals, there is limited market data for combined positions such as this one. Therefore, Human Resources has averaged the market data for these positions to recommend placement in the General Employees’ Salary Schedule at range 56 - $38,982 - $47,044. FISCAL IMPACT: The estimated annual salary and benefit cost to reclassify this position is $3,600. The increased cost for the remainder of this fiscal year is approximately $2,100. The City Attorney’s Office is able to fund this amount within their current department account to cover this additional cost. That the above recitations are true and correct. 20 2. That the City Council adopts the classification of Legal Assistant, as 21 22 23 described in Attachment A, attached hereto and made a part thereof. 3. CITY OF CARLSBAD CLASSIFICATION SPECIFICATION CITY ATTORNEY BASIC FUNCTION: Under general supervision, performs a wide range of legal support work in conjunction with the City Attorney’s Office; conducts legal research, including state and federal case law, statutes and legislation; prepares legal documents, including all court filings and litigation related correspondence; assists attorneys in litigation of civil and criminal cases; reviews and prepares contracts, agreements and citations for attorney approval; and performs a wide range of paralegal and legal secretarial duties as assigned. DISTINGUISHING CHARACTERISTICS: Employees in this classification are expected to possess the complete knowledge, skills and abilities to perform a wide variety of journey level legal support work. Employees at this level receive only occasional instruction or assistance as new or unusual situations arise. The work involves maintaining strict confidentiality of all matters processed through the office of the City Attorney. KEY RESPONSIBILITIES: Perform legal research; prepare documents for civil litigation and code enforcement; and organize and maintain litigation and litigation form files. Compose, type and compile pleadings, including answers, complaints, motions, appellate and trial briefs, affidavits, discovery and other legal documents and related correspondence, case memoranda, reports, and exhibits. Support in-house staff as needed in coordinating legal activities, such as, assist with depositions, trials and other legal events; inform attorneys of pertinent activities; schedule and arrange meetings for attorneys, calendar, organize, monitor and retrieve all court dates, legal deadlines, meetings and other important dates; arrange, contact and coordinate investigators and experts; request subpoenas of records and/or witnesses and review documents; and maintain telephone contact with courts, witnesses and outside counsel. Prepare agenda bills, ordinances and resolutions as assigned. Prepare and maintain a variety of records, reports and files related to the City Attorney’s office.
