Recreation CITY MGR RECOMMENDED ACTION: Awv m, AdJp Approve the Ratification of Amendment No. 1 to the existing agreement with KTU+A for design of Phase II of the Carrillo Ranch. ITEM EXPLANATION: On March 7, 2000, the City Council approved a contract with KTU+A for design of Phase II of the Carrillo Ranch. The original contract was for $292,845. The consultant and staff have been working toward completion of the work and anticipate bringing the plans and specification before Council in the next couple months to authorize going to bid. The original scope of work for the consultant was based on the Leo Carrillo Master Plan document which provided a general concept of the work to be done in Phase II. As the design development progressed, new design challenges have arisen. Because this is an historic site, with many hidden and unique existing site conditions related to the buildings and grounds, an unusually high occurrence of unforeseen issues have surfaced that have required architectural and engineering solutions: 1. A high ground water table was discovered that required further geotechnical work and engineering solutions. 2. Additional water and sewer service was required when it was discovered that the existing systems were inadequate. I 3. I New drainage facilities were engineered to eliminate erosion around the stable and barn area. 4. The two windmills on site required structural engineering stabilization. 5. Additional electrical engineering was required due to lack of adequate existing ~ facilities. 6. Additional structural studies and engineering to stabilize Deedie’s House will be required to address recent deterioration of the structure. A portion of this work has already been completed in order to keep the project moving forward. All the above work items are included in the attached Ratification of Amendment 1 ~ of the existing contract with KTU+A. FISCAL IMPACT: The negotiated fee for the additional design work outlined above is $85,026. There is sufficient fund in the Carrillo Ranch capital improvement account that will cover the additional design fees. The following figures outline the original CIP budget amounts and revised project cost estimates. Construction Total Budget $ 375,000 3,617,OOO $3,992,000 Cost estimates for construction of the project have recently been received from the design consultants. Utilizing these new figures, the revised design costs requested in this Agenda Bill, and updated administration figures, the current budget status is as follows: CURRENT PROJECT ESTIMATED COSTS KTU+A original fee $ 293,000 KTU+A additional fee (as requested in this agenda bill) 85,000 Administration and miscellaneous costs 15,000 *Construction estimate (including contingencies) 3,399,ooo Engineering inspection 200,000 TOTAL ESTIMATED PROJECT COSTS $3,992,000 *Construction estimates are the consultant’s best opinion of probable costs. WHEREAS, the City Council of the City of Carlsbad, California, has determined it necessary and desirable, and in the public interest to amend an existing contract with KTU+A for the design of Phase II of Carrillo Ranch; and WHEREAS, the City and KTU+A have agreed on the additional scope of work and fee; and WHEREAS, funds for the additional work are available in the Carrillo Ranch Phase II Capital Improvement Program account; and WHEREAS, a portion of the work described in Amendment No. 1 has been completed. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, the following: 1. That the above recitations are true and correct. 2. That Amendment No. 1 to the existing agreement with KTU+A for design of Phase II of Carrillo Ranch is hereby ratified and the Mayor and City Clerk are authorized and directed to execute said agreement. 3. NOES: None ABSENT: None ATTEST: RATIFICATION OF AMENDMENT NO.1 TO AGREEMENT WITH KTU+A FOR DESIGN OFCARRILLO RANCH PHASE II This Ratification of Amendment 1 is entered into the 1st day of February , 2001 but effective as of the 1st day of August, 2000, ratifying the amendment of the Agreement dated March 10, 2000, and between the City of Carlsbad, a municipal corporation, hereinafter referred to as “City”, and KTU+A, hereinafter referred to as, “Contractor” for design of Carrillo Ranch Phase II. RECITALS WHEREAS, the initial Agreement, dated March IO, 2000, identified a scope of work which includes the preparation of construction documents and construction observation services for Carrillo Ranch Phase It; and WHEREAS, the parties to the Agreement desire to alter the scope of work as follows: Add additional scope of work and design services including architectural work, structural recommendations, geotechnical investigations, civil engineering, and electrical engineering, as set forth in Exhibit “A”; and WHEREAS, a supplemental scope of work and fee schedule have been negotiated and agreed to between the parties, and is attached hereto and incorporated herein by reference as Exhibit “A” Scope of Services and Fee; and WHEREAS, the City and Contractor desire to ratify any amended scope of work already performed by the Contractor without benefit of this amendment of the Agreement dated March 10, 2000; NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, City and Contractor hereby agree as follows: 1. The retroactive amendment of the Agreement is ratified. 2. Contractor shall provide services as outlined on the attached Exhibit “A”. 02104100 3. City shall pay Contractor for all work associated with Paragraph 1 above, on a lump sum basis not-to-exceed $85,0026. Contractor shall complete all work outlined on the attached Exhibit “A” by March 30, 2001, or by expiration of the Agreement as amended hereby. 4. All other provisions of the Agreement and any amendments thereto shall remain in full force and effect. 6. All requisite insurance policies to be maintained by the Contractor pursuant to the Agreement and any amendments thereto shall be extended to include coverage for the extension period.
