I RECOMMENDED ACTION:
Adopt Resolution No. m/ -56 accepting bids and awarding the contract to American
Restoration & Construction for the construction of the Seawall Stairway Repair Project No. 35191.
I ITEM EXPLANATION:
The Seawall Stairway Repair Project will replace all of the concrete treads at the staircase between Sycamore and Chestnut Avenues (Location Map). On January 23, 2001 four sealed bids were received for the construction of this project:
American Restoration & Construction $35,160
Lesicka Construction $36,100
Murray Builders $43,472
KAS Equipment & Rental $72,900 .
The lowest responsible bidder was American Restoration and Construction for $35,160.

ENVIRONMENTAL COMPLIANCE:
The City has secured a Minor Coastal Development Permit (CDP 00-49) dated October 24, 2000.
This project is categorically exempt from the environmental review process under Section 15302 (Class 2) of the California Environmental Quality Act which exempts the replacement or
reconstruction of facilities with similar materials.
FISCAL IMPACT:
The following is a breakdown of costs to complete this project:
Construction (Low Bidder) $35,160
Inspection and Project Management (15%) $5,274
Construction Contingencies (15%) $5,274
Total $45,708
I Sufficient funds are available in the Miscellaneous Beach Access Upgrades account #35191.

2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A
CONTRACT FOR THE CONSTRUCTION OF THE SEAWALL
4 STAIRWAY REPAIR PROJECT NO. 35191.
5 WHEREAS, plans have been reviewed by the City Council of the City of Carlsbad for the
6 construction of the Seawall Stairway Repair Project No. 35191; and
7 WHEREAS, four (4) sealed bids were received on January 23, 2001 by the City of
8 Carlsbad for the construction of said project; and
WHEREAS, the low bid to construct said project was submitted by American Restoration 9
and Construction, Inc.; and

WHEREAS, the total estimated cost for said project if performed by American Restoration
and Construction, Inc., is $45,708; and
12 WHEREAS, subsection 3.28.172( c )( 1 ) of the Carlsbad Municipal Code authorizes the
l3 City Manager to approve change orders in the amount equal to the contingency set at the time of
14 bid opening; and
15 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
I6 California, as follows:
17 1. That the above recitations are true and correct.
2. 18 That the low bid of $35,160 submitted by American Restoration and Construction,
Inc. for the construction of the Seawall Stairway Repair Project No. 35191 is accepted and the 19

is hereby authorized to execute a contract therefor.

3. That the award of this contract is contingent upon the bidder submitting the lowest
responsive bid executing the required contract and submitting the required bonds and insurance
policies, as described in the contract, within twenty (20) days of adoption of this resolution.
The City Manager may grant reasonable extensions of time.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 20th day of February t 2001 by the following vote, to wit:
AYES: Council Members Lewis, Kulchin, Finnila, Nygaard and Hall.
