CLK CITY OF CARLSBAD -AGENDA BILL ADOPTION OF ORDINANCE NO. NS-575 AMENDING THE CARLSBAD MUNICIPAL CODE TO COMPLY WITH THE AMENDMENTS TO THE POLITICAL REFORM ACT DEPT. HD. CITY ATTY. CITY MGR RECOMMENDED ACTION: Adopt Ordinance No. NS-575 amending Section 1.14.030 of the Carlsbad Municipal Code to comply with the amendments to the Political Reform Act. ITEM EXPLANATION: Ordinance No. NS-575 was introduced and first read at the City Council meeting held on February 20 2001. The second reading allows the City Council to adopt the ordinance, which would then become effective in thirty days. The City Clerk will have the ordinance published within fifteen days, if adopted. NS-575 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA TO AMEND SECTION 1.14.030 OF THE CARLSBAD MUNICIPAL CODE TO COMPLY WITH AMENDMENTS TO THE POLITICAL REFORM ACT. The City Council of the City of Cartsbad, California does ordain as follows: SECTION I: That section 1.14.030 of the Carlsbad Municipal Code is amended to read as follows: “1.14.030 Conflict of interest--Disaualifications. (a) The regulations adopted by the Fair Political Practices Commission provide that a public official may not participate in a governmental decision when the official has an interest in real property which is located within a five-hundred-foot radius of the boundaries or proposed boundaries of a property which is the subject of a decision before the official unless that decision will have no financial effect upon an official’s interest. (b) This section imposes a stricter standard for all public officials and designated employees in the city who shall not’ participate in a decision when those public officials or designated employees have an interest in real property located within a six-hundred-foot radius of the boundaries of the property which is the subject of a decision unless that decision will have no financial effect upon that interest. Except as modified by this section, all public officials and designated employees in the city shall comply in all other respects and with all other provisions of the material financial effect rules in the Commission’s regulations.” EFFECTIVE DATE: This ordinance shall be effective thirty days after its adoption, and ‘the City Clerk shall certify the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen days after its adoption.
