RECOMMENDED ACTION:
Adopt Resolution No. 200 / - 7 b authorizing the mayor to execute an
agreement to lease one surplus police vehicle a year for five years to
Palomar College, for use in colleges’ Criminal Justice Program.
ITEM EXPLANATION:
Palomar College offers the basic police course in an extended format. The’
extended format is distinct from the regular police academy in that it is an
approximately one-year course and is scheduled to allow the working adult
to attend. The academy creates a pool of candidates who otherwise could
not become police officers. The City of Carlsbad will ultimately benefit from
the program by having a larger pool of candidates from which to choose.
Loraine Brealey, Public Safety Coordinator, has asked the City to lease
surplus police vehicles to be used in the training academy. In the past, the
City of Carlsbad has leased “retired” police vehicles to the College for one-
dollar a year. The College would maintain and use these vehicles until
there were no longer operable and of use. The vehicles would then be
returned to the City of Carlsbad to sell at auction.
This new agreement would allow for the leasing of one police vehicle to the
College for one year. The vehicle would then be returned to the City, and
be sold at county auction. The City would then lease another “newly
retired” police vehicle to the College. The benefit to Palomar College is that
they will have a continuous source of newer police training vehicles. The
benefit to the City of Carlsbad is that the lost value when selling the vehicle
at auction is the difference of the resale price of only one year.
The one-dollar leasing fee is implemented to establish liability
responsibility to Palomar College.
FISCAL IMPACT:
Surplus patrol vehicles are sold at the county auction annually for $3,000
- 6,000, depending on their condition. After one-year utilization in a
training academy, the estimated value of the vehicles would likely be
between $3,000 - 5,000. The city should expect to lose approximately
$1,000 per year.
Pursuant to Public Resources Code section 2 1065 and CEQA Guideline
section 15378, this matter does not constitute a “project” within the
meaning of CEQA and, therefore, does not require environmental review.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF CARLBBAD, CALIFORNIA, AUTHORIZING THE
MAYOR TO EXECUTE AN AGREEMENT TO LEASE
SURPLUS POLICE VEHICLES TO PALOMAR COLLEGE
WHEREAS, the College offers basic police academy courses in an
extended format, which allows working adults to attend; and
WHEREAS, the College needs the temporary use of surplus police
vehicles for training and other academy program support purposes; and
WHEREAS, the City benefits from the academy program because it
creates a pool of potential applicants for City police officer openings; and
WHEREAS, the City periodically has surplus police vehicles
available for lease to the College on a temporary basis, not to exceed
twelve (12) months;

1 NOW, THEREFORE, the City Council of the City of Carlsbad,

AGREEMENT BETWEEN THE CITY OF CARLSBAD, AND THE
PALOMAR COMMUNITY COLLEGE DISTRICT FOR THE
LEASE OF SURPLUS POLICE VEHICLES.
This agreement is made this -3-d.. day of April , 2001 (“Effective
Date”), between the City of CarJsbad (“the City”) and Palomar College District
(“the College”)
Recitals
WHEREAS, the College offers basic police academy courses in an
extended format, which allows working adults to attend; and
WHEREAS, the College needs the temporary use of surplus police
vehicles for training and other academy program support purposes; and
WHEREAS, the City benefits from the academy program because it
creates a pool of potential applicants for City police officer openings; and
WHEREAS, the City periodically has surplus police vehicles available
for lease to the College on a temporary basis, not to exceed twelve (12)
months;
NOW, THEREFORE, in consideration of the above recitals, the parties
agree as follows:
1. The City will lease to the College for use in the College’s police
academy program one (1) surplus vehicle, including emergency lighting
equipment, per year for five (5) years. At the end of each year, the College will
exchange the existing surplus vehicle for a different surplus vehicle, so that
no surplus vehicle is used by the College for more than ( 12) months.
2. The College will pay the City one dollar ($1 .OO) per surplus
vehicle, payable upon delivery of the surplus vehicle to the College.
3. This Agreement will commend on the Effective Date above and
will terminate automatically five (5) years from the date the first surplus
vehicle is delivered to the College. In addition, either party may terminate
this Agreement at anytime for any reason by giving the other party thirty (30)
days written notice.
4. The College will paint and detail each vehicle upon receipt. The
College will also maintain, repair, and provide fuel for each vehicle while the
vehicle is being used by the College under this Agreement.
5. The College agrees to indemnify, defend and hold the City
(including its officers, employees, agents, and elected official) harmless from
all claims, demands, losses, damages, costs, expenses,. obligations and
liabilities for personal injury, death or property damage (whether intentional
or negligent) arising out of the College’s use of the surplus vehicles leased to
the College under this Agreement.
6. The college will obtain, and maintain in full force and effect
during the term of this Agreement, automobile insurance with a minimum
coverage of $l,OOO,OOO (combined single limit per accident) to protect
against the College’s liability for personal injury, death, and property
damage. The City will be named as an additional insured on the insurance
policy and the City will receive thirty (30) days prior written notice, by
certified mail, prior to the policy being canceled. If the college is self-insured
for all or a portion of the above coverage, the College will provide the City
with a certificate confirming this status.
7. A detailed description of the first surplus vehicle to be provided
under this Agreement, including the year, make, license plate number, and
VIN number, will be attached as Exhibit A prior to the execution of this
agreement. Each year the City will update and provide the College with an
amended Exhibit A reflecting which surplus vehicle has been returned to the
City and which surplus vehicle has provided to the College in its place.
8. This Agreement constitutes the entire agreement between the
parties and supersedes any prior oral or written agreement. This Agreement
may not be modified except in writing signed by both of the parties.
