IT CITY MGRa RECOMMENDED ACTION: Staff recommends Council adopt Resolution No. do0 I- /I I, approving the membership of the City of Carlsbad in Novell’s Master License Agreement with the State of California. ITEM EXPLANATION: In 1987, the City’s Information Technology department selected Novell’s Netware as the network operating system (NOS) for the citywide PC network and we continue to use Netware for this purpose today. As the use of our citywide network has increased over the years, we have added Netware licenses and additional Novell products, including Groupwise for email, Border Manager for our Internet firewall and Zenworks for desktop management. Recently, the Information Technology department became aware of Novell’s Master License Agreement (MLA) with the State of California. This multi-year agreement, July 1, 2000 to June 30, 2002, provides California governmental agencies access to volume savings for purchasing Novell software, maintenance, technical support and many additional Novell services not available when purchasing off-the-shelf product. This agreement is much like other cooperative agreements the City utilizes to improve our purchasing power for both product and services. To purchase under the Master License Agreement, membership into the program is required. While membership itself has no contractual obligations, for continued participation it does require that software maintenance is purchased and renewed annually for those products in use. This software maintenance includes upgrades to new product releases and technical support. Thus, participating in the MLA benefits the Information Technology department and the City in several ways. That is, Information Technology is able to purchase Novell’s technology at the best possible price, receive upgrades to the products now in use by the City and have direct access to Novell’s technical support for issue resolution. Staff has determined that participating in the MLA is the best method with which to both procure Novell products and maintain our investment in existing Novell software. FISCAL IMPACT: This fiscal year the cost for purchasing new, and maintaining existing, Novell product licenses under the MLA is approximately $51,000. Funds to cover these costs are included in Information Technology’s 2000-2001 budgets. While the cost per license cannot increase during the term of MLA, June 1, 2000 to July 1, 2002, our overall costs can change year to year based on the quantity of licensed products in use by the City. WHEREAS, on July 1, 2000 the State of California and Novell, Inc. II executed a Master License Agreement (the “Master Agreement”) whereby Novell, among other things, agreed to provide licenses, implementation services and maintenance for its software; and WHEREAS, the Master Agreement allows local government agencies in the State of California to contract with Novell, Inc. for the purchase of licenses, /I implementation services and maintenance pursuant to the terms of the Master Agreement; and WHEREAS, the Master Agreement term expires on June 30,2002; and WHEREAS, the City of Carlsbad has, in the past, purchased software licenses and maintenance services from Novell, Inc.; and WHEREAS, the City of Carlsbad wishes to purchase, pursuant to the terms of the Master Agreement, additional software licenses, implementation services and maintenance from Novell, Inc. WHEREAS, pursuant to the Master Agreement, the City is to pay Novell, II Inc. for software licenses, implementation services and maintenance at the end of each fiscal year. SECTION 3: That the City Manager is authorized to execute the Master License Agreement Membership with Novell, Inc. SECTION 4: That funds are appropriated in the amount of $51,000 for software licenses and maintenance services from Novell, Inc. during fiscal year 2000- 2001. SECTION 5: That the City Manager is authorized to approve the expenditure of funds up to $75,000 for fiscal year 2001-2002 software licenses, implementation services and maintenance pursuant to the Master Agreement based upon a satisfactory review of Contractor’s performance; City needs; and, appropriation of funds by the City Council. PASSED, APPROVED AND ADOPTED at a regular meeting of the City Council of the City of Carlsbad held on the 10th day of April , 2001 by the following vote, to wit: AYES: Council Members Lewis, Kulchin, Finnila, Nygaard and Hall.
