ENG TITLE- -- ESTABLISH A PRIMA FACIE SPEED LIMIT UPON A PORTION OF AVIARA PARKWAY I RECOMMENDED ACTION: Introduce Ordinance No. N$ss! to establish a prima facie 45 mile per hour speed limit upon Aviara Parkway from Poinsettia Lane to Palomar Airport Road. ITEM EXPLANATION: Between Poinsettia Lane and Palomar Airport Road, Aviara Parkway is designed as a major arterial on the Circulation Element of the General Plan. This 1.07 mile road segment has a design speed of 50 miles per hour and follows a curvilinear alignment. Aviara Parkway is constructed to City standards with two lanes in each direction, bicycle lanes in both directions, a landscaped center median for most of the road segment, street lights, curb and gutter and sidewalk. South of Palomar Airport Road the Average Daily Traffic (ADT) volume on Aviara Parkway is 5,200 vehicles. Speed surveys were conducted on Aviara Parkway near the Camino de las Ondas intersection and at a point north of Cobblestone Road. The critical speeds (8!Yh percentile) were found to be 45 miles per hour in both locations. Sections 22357 and 22358 of the California Vehicle Code authorizes local authorities to establish a prima facie speed limit on the basis of the results of an Engineering and Traffic Survey. The Engineering and Traffic Survey considers such factors as the number of collisions that have occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight distance, and conditions that may not be readily apparent to the driver. At their meeting on November 6, 2000, the Traffic Safety Commission considered the results of the Engineering and Traffic Survey to establish the prima facie speed limit upon this portion of Aviara Parkway. The Commission recommended by a 3-O vote to establish a 45 mile per hour prima facie speed limit upon Aviara Parkway from Poinsettia Lane to Palomar Airport Road. The portion of Aviara Parkway from Poinsettia Lane to El Camino Real is a secondary arterial on the Circulation Element. It has a design speed of 40 miles per hour and has a posted speed limit of 40 miles per hour. The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic Engineer. I FISCAL IMPACT: Installing six speed limit signs on Aviara Parkway between Poinsettia Lane and Palomar Airport Road will cost about $750. EXHIBITS: 1. Location Map. 2. Ns-‘j81 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE REVISION OF SECTION 10.44.330 TO ESTABLISH A PRIMA FACIE 45 MILE PER HOUR SPEED LIMIT UPON AVIARA PARKWAY FROM POINSETTIA LANE TO ITS INTERSECTION WITH PALOMAR AIRPORT ROAD. The City Council of the City of Carlsbad, California, hereby ordains as follows: SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended by the revision of Section 1044.330 to read as follows: ‘I 044.330 Aviara Parkway: a. Upon Aviara Parkway from Poinsettia Lane to its intersection with El Camino Real, the prima facie speed limit shall be forty miles per hour. b. Upon Aviara Parkway from Poinsettia Lane to its intersection with Palomar Airport Road, the prima facie speed limit shall be forty-five miles per hour.” EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Catlsbad within fifteen (15) days after its adoption. INTRODUCED AND FIRST READ at a regular meeting of said City Council held on the 17thdayof April ,2001, and thereafter, PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the of day ,200l by the following vote, to wit: AYES: NOES: ABSENT: CLAUDE A.
