NS-581 MTG. 4-24-01 ESTABLISHING A SPEED LIMIT ON A PORTION DEPT. CLK OF AVIARA PARKWAY DEPT. HD. CITY ATTY. CITY MGR RECOMMENDED ACTION: Adopt Ordinance No. NS- 581 amending Section Title 10, Chapter 10.44 of the Carlsbad Municipal Code by the revision of Section 10.44.330 to establish a prima facie 45 mile per hour speed limit upon Aviara Parkway from Poinsettia Lane to its intersection with Palomar Airport Road. ITEM EXPLANATION: Ordinance No. NS-581 was introduced and first read at the City Council meeting held on April 17, 2001. The second reading allows the City Council to adopt the ordinance, which would then become effective in thirty days. The City Clerk will have the ordinance published within fifteen days, if adopted. Ns-581 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE REVISION OF SECTION 1044.330 TO ESTABLISH A PRIMA FACIE 45 MILE PER HOUR SPEED LIMIT UPON AVIARAPARKWAY FROM POINSETTIA LANE TO ITS INTERSECTION WITH PALOMAR AIRPORT ROAD. The City Council of the City of Carlsbad, California, hereby ordains as follows: SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended by the revision of Section 1044.330 to read as follows: ‘10.44.330 Aviara Parkwav: a. Upon Aviara Parkway from Poinsettia Lane to its intersection with El Camino Real, the prima facie speed limit shall be forty miles per hour. b. Upon Aviara Parkway from Poinsettia Lane to its intersection with Palomar Airport Road, the prima facie speed limit shall be forty-five miles per hour.” EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen (15) days after its adoption. INTRODUCED AND FIRST READ at a regular meeting of said City Council held on the 17thdayof April ,2001, and thereafter, PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council held on the 24th day of April (2001 by the following vote, to wit: AYES: Council Members Finnila, Nygaard and Hall.
