originally dedicated to the City of Carlsbad at Aviara Phase III Unit 3.
ITEM EXPLANATION:
This is a request by Aviara Serenata, LLC to quitclaim portions of existing open space easements
located at Aviara Phase III Unit 3, at the back of the properties fronting Amante Court and Calliandra
Road. These properties are all presently developed but not occupied.
The open space easements were originally dedicated as part of the final map for Carlsbad Tract
CT 92-03 Unit 3. The subject open space easements were required to prevent development over
proposed slopes and for maintenance purposes by the Aviara Master Association. The open space
is not part of the City designated open space, it does not contain any habitat, and was not required
by the Coastal Commission. The developer is requesting that a portion of the open space be
quitclaimed in order to extend the rear yards of five of the lots fronting Amante Court. By extending
the rear yards, the required setback to accommodate second story balconies would be met. In order
not to decrease the overall open space area, the developer has offered to dedicate an equivalent
area of new open space. The acceptance of ,the dedication will be handled administratively. The
City’s interest will be protected by having all of the documents necessary to accomplish the desired
existing open space easement quitclaim and new open space easement dedication held at the City
Clerk’s Office. Once the quitclaim is approved by Council, the City Clerk will forward the documents
to the Recorder’s Office for simultaneous recordation. The total area of the open space to be
quitclaimed, and dedicated, is approximately 2,290 square feet or 0.053 of an acre.
Planning and Engineering staff has reviewed the requested quitclaims. Staff recommends approval
of the open space quitclaims requested by Aviara Serenata, LLC.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING AND AUTHORIZING
EXECUTION OF QUITCLAIM DEEDS FOR PORTIONS OF
EXISTING OPEN SPACE EASEMENTS ORIGINALLY DEDICATED
TO THE CITY OF CARLSBAD AT AVIARA PHASE Ill UNIT 3.
WHEREAS, Aviara Serenata, LLC has submitted a request for quitclaims for portions of
existing open space easements originally dedicated to the City of Carlsbad over a portion of
\viara Phase III Unit 3; and
WHEREAS, the open space is not part of the City designated open space, does not
:ontain any habitat, and was not required by the Coastal Commission; and
WHEREAS, the quitclaims are necessary to extend the rear yards of the residential lots
ronting Amante Court; and
WHEREAS, the rear yard extensions are needed to accommodate second story balconies;

WHEREAS, the open space being quitclaimed will be replaced by the dedication of new
lpen space of an equivalent area; and
WHEREAS, the City Council of the City of Cartsbad has determined it to be in the public

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
ialifornia, as follows:
1. That the above recitations are true and correct.
2. That the 5 quitclaim deeds quitclaiming portions of the existing open space
asements to the current property owners, which are on file in the City Clerk’s office and are
lcorporated by this reference; are approved.
That the Mayor is authorized to sign the original 5 Quitclaim Deeds and the City
Deeds to be recorded in the Office of the
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 24th day of April 9 2001 by the following vote, to wit:
