RECOMMENDED ACTION:
Introduce Ordinance No. us-583 to establish a prima facie 40 mile per hour speed limit upon
Faraday Avenue from College Boulevard to Cannon Road.
ITEM EXPLANATION:
Faraday Avenue is designated as a collector street on the Circulation Element of the General Plan
between College Boulevard and Cannon Road. This 1.82 mile road segment follows a curvilinear
alignment with a portion of the road striped with four traffic lanes and a portion having two traffic lanes. The road has been constructed to City standards with curb and gutter, sidewalk and street
lights on each side of Faraday Avenue.
West of College Boulevard the Average Daily Traffic (ADT) volume on Faraday Avenue is 7,900
vehicles and southerly of Cannon Road the ADT is 4,800 vehicles. Faraday Avenue has a design
speed of 40 miles per hour. The portion of Faraday Avenue from College Boulevard to Orion Street
currently has a prima facie 40 mile per hour speed limit previously established.
Sections 22357 and 22358 of the California Vehicle Code authorizes local authorities to establish a
prima facie speed limit on the basis of the results of an Engineering and Traffic Survey.
The Engineering and Traffic Survey considers such factors as the number of collisions that have
occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic
volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight
distance, and conditions that may not be readily apparent to the driver.
At their meeting on March 5, 2001, the Traffic Safety Commission considered the results of the Engineering and Traffic Survey to establish the prima facie speed limit upon this portion of Faraday
Avenue. The Commission recommended by a 5-O vote to establish a 40 mile per hour prima facie speed limit upon Faraday Avenue from College Boulevard to Cannon Road.
The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic
Engineer.
FISCAL IMPACT:
No fiscal impact. Speed limit signs have previously been installed.

CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER
10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE
AMENDMENT OF SECTION 1044.320 TO ESTABLISH A PRIMA
FACIE 40 MILE PER HOUR SPEED LIMIT UPON FARADAY
AVENUE FROM COLLEGE BOULEVARD TO CANNON ROAD.
The City Council of the City of Carlsbad, California, hereby ordains as follows:
SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended
by the revision of Section 1044.320 to read as follows:
“1044.320 Faradav Avenue:
a. Upon Faraday Avenue from College Boulevard to its intersection with Orion Street, the prima facie speed limit shall
be forty miles per hour.
b. Upon Faraday Avenue from College Boulevard to Cannon Road, the prima facie speed limit shall be forty miles per
hour.”
EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption
and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to
be published at least once in a newspaper of general circulation in the City of Carlsbad within
fifteen (15) days after its adoption.
INTRODUCED AND FIRST READ at a regular meeting of said City Council held on the
1st day of May ,2001, and thereafter,
