I RECOMMENDED ACTION:
Adopt Resolution No. 2 06 1 k /69 authorizing the Finance Director to reimburse Cypress
Valley, LLC $108,500 for the installation of a traffic signal at the Carlsbad Village Drive and
Tamarack Avenue intersection, and pay GVP Consultants $1,500 for reimbursable auditing
expenses.
I ITEM EXPLANATION:
Planning Condition of Approval No. 8 for Calavera Hills Village Q (CT 83-32/PUD-62) requires that
the project comply with all conditions and mitigation measures which may be required as part of the
Zone 7 Local Facilities Management Plan (LFMP). Mitigation measure C.2.b of the LFMP for Zone 7
requires the construction of the traffic signal at Carlsbad Village Drive and Tamarack Avenue.
Carlsbad Village Drive and Tamarack Avenue are Circulation Element Streets, and the traffic signal
is included in the City’s Capital Improvement Program (CIP). Therefore Cypress Valley, LLC, is
eligible for reimbursement for the construction costs.
On January 12, 1999, HMS Construction, Inc. was awarded a contract by McMillin Land
Development in the amount of $95,760 for construction of a Traffic Signal at Carlsbad Village Drive
and Tamarack Avenue Intersection. HMS Construction, Inc. completed the work on March 26,
2001. Cypress Valley, LLC has submitted documentation for $111,467 of reimbursable expenses
for the design and construction of the traffic signal.
Through the City’s CIP, the City Council appropriated $110,000 in Public Facility Fee (PFF) funds for
the installation of this traffic signal. A qualified auditing engineer, GVP Consultants, was retained by
the Engineering Department to review and analyze the $111,467 of reimbursable expenses. The
audit report provided by GVP Consultants indicates that the $111,467 are appropriately-documented
reimbursable expenses. Engineering staff concurs with the report and recommends that Cypress
Valley, LLC be reimbursed $108,500 for the installation of the Carlsbad Village Drive/Tamarack
Avenue traffic signal, and that GVP Consultants be paid $1,500 for reimbursable auditing expenses.

The 1999-2000 Capital Improvement Program indicates a current appropriation of $110,000 in PFF
funds for installation of a traffic signal at the Carlsbad Village Drive/Tamarack Avenue intersection,
referenced as Project No. 34811. The financing matrix for the Zone 7 LFMP specifies that any
difference between construction cost and CIP funding will be the developer’s financial responsibility.
Staff is recommending reimbursement of $110,000 for the $112,967 in reimbursable expenses, with
a reimbursement of $108,500 to Cypress Valley, LLC, and a payment of $1,500 to GVP
Consultants.
ENVIRONMENTAL REVIEW:
The Planning Commission approved a Negative Declaration for CT 83-32 on May 7, 1984. The
traffic signal was installed pursuant to conditions of approval for CT 83-32.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AUTHORIZING REIMBURSEMENT TO
CYPRESS VALLEY, LLC, AND GVP CONSULTANTS FOR THE
CONSTRUCTION OF A TRAFFIC SIGNAL AT CARLSBAD
VILLAGE DRIVE AND TAMARACK AVENUE, PROJECT NO. 34811
WHEREAS, installation of a traffic signal at the Carlsbad Village
Drive/Tamarack Avenue intersection was a mitigation measure of the Zone 7 Local
Facilities Management Plan (LFMP); and
WHEREAS, the Conditions of Approval for Calavera Hills Village Q (CT 83-
32/PUD-62) require compliance with all conditions and mitigation measures of the
Zone 7 LFMP; and
WHEREAS, the financing matrix of the Zone 7 LFMP indicated that
reimbursement would be paid through appropriated Public Facilities Fee (PFF)
funds; and
WHEREAS, Cypress Valley, LLC installed said traffic signal: and
WHEREAS, Cypress Valley requests reimbursement in the amount of
$110,000 for the installation of said traffic signal; and
WHEREAS, an audit was conducted and the Public Works Director
approves reimbursement in the amount of $110,000; and
WHEREAS, there is currently $110,000 available for reimbursement in the
City’s Capital Improvement Program (CIP) through Public Facilities Fees (PFF) for
the installation of said traffic signal, referred to as CIP Project No. 34811; and
WHEREAS, the Public Works Director requests that the City Council
authorize the Finance Director to reimburse Cypress Valley, LLC in the amount of
$108,500 for the installation of said traffic signal and reimburse GVP Consultants in
the amount of $1,500 for auditing costs.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Carlsbad, California, as follows:
1. That the above recitations are true and correct.
2. That adequate funds are available in the City’s Capital Improvement
Program to reimburse Cypress Valley, LLC for the installation of a traffic signal at
1 the Carlsbad Village Drive/Tamarack Avenue intersection;
2 3. That City Council authorize the City’s Finance Director to reimburse
3 Cypress Valley, LLC in the amount of one-hundred and eight thousand, five-
4 hundred dollars ($108,500) for the installation of a traffic signal at the Carlsbad
Village Drive/Tamarack Avenue intersection. 5
4. That City Council authorize the City’s Finance Director to pay the
6 auditing engineer, GVP Consultants the amount of one thousand, five hundred
7 dollars ($1,500) for reimbursable auditing costs in connection with the traffic signal
8 at the Carlsbad Village Drive/Tamarack Avenue intersection.
