ITEM EXPLANATION:
Cannon Road crosses a City-owned parcel near the intersection with Faraday Avenue. Faraday Avenue Extension is one mile of roadway extending from its previous westerly terminus to Cannon Road. The roadway traverses land owned in fee by the City of Carlsbad and commonly known as Veterans Memorial Park. Cannon Road has a small portion of roadway located on Veteran Memorial Park as well.
Typically, public streets are dedicated by the landowner to the City through a grant deed. Since the City owns the land and the City cannot dedicate an easement to itself, the portion used for public street purposes must be dedicated by resolution. The roadway serves as a corridor for several franchise utilities. Staff recommends that the Council dedicate the above described land for public street and appurtenant uses by the attached resolutions.
ENVIRONMENTAL:
The Planning Director has determined that the requested action is consistent with prior CEQA review. The project was reviewed in the Mitigated Negative Declaration, approved on September 8, 1998. Significant environmental impacts identified by those CEQA documents were determined to be mitigable to levels of less than significant. All permits have been received.
FISCAL IMPACT:
Recording fees are estimated to be $100. Sufficient funds are available in the project accounts.

5 WHEREAS, the City of Carlsbad is the owner of certain real property situated in the City of
6 Carlsbad, County of San Diego, State of California, as more particularly described in a legal
7 description thereof, marked Exhibit “A”, and as shown on a sketch thereof, marked Exhibit “B”,
8 attached hereto and incorporated herein by this reference; and
9 WHEREAS, there is a public improvement project that requires the extension of a public
IO street commonly known as Faraday Avenue, and that said project will require right-of-way
11 including said real property; and
12 WHEREAS, The City Council desires to dedicate said real property for public street
13 right-of-way and appurtenant uses.
14 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
15 California, as follows:
16 1. That the above recitations are true and correct.
17 2. That the City-owned real property described in said Exhibit “A” and as shown in
18 said Exhibit “B” is hereby dedicated for public street right-of-way and appurtenant uses.
