CITY OF CARLSBAD - AGENDA BILL
AUTHORIZE STAFF THE EXECUTION OF ALL
NECESSARY FORMS FOR THE CALIFORNIA
BEVERAGE CONTAINER RECYCLING AND LITTER
REDUCTION ACT PROGRAM
RECOMMENDED ACTION:
Adopt Resolution No. 200 I- ltifjauthorizing the City Manager, or designee to execute in
the name of the City of Carlsbad all necessary forms for the purpose of securing payments
and to implement and carry out the purposes specified in Section 14581 (a)(4)(A) of the’
California Beverage Container Recycling and Litter Reduction Act.
ITEM EXPLANATION:
Pursuant to Section 14581 (a)(4)(A) of the California Beverage Container Recycling and Litter
Reduction Act, the Department of Conservation is distributing a total of $10,500,000 to
eligible cities and counties specifically for beverage container recycling and litter cleanup
activities. Each city is eligible to receive a minimum of $5,000 or an amount calculated by
the state, per capita based, whichever is greater.
The per capita amount calculated by the state is based upon the population, as of January 1, 2000, in incorporated areas of a city, as stated in the Annual Demographic Report submitted
to the Governor by the Department of Finance. The City of Carlsbad is eligible to receive
$23,593 for this program.
Staff submitted a funding request form to the state that describes the recycling activities for
which the funds mentioned above will be expended. Staff is requesting these funds be used
to establish a beverage container recycling program at six City owned parks for public use.
Each of the six parks will receive sets of three containers (aluminum, glass and plastic)
designated for recyclable materials only. The new containers will be placed adjacent to
existing trash receptacles to limit additional staff time for collecting the recyclable materials.
Attached, as Exhibit 2 is a sample picture of the containers.
City staff will be responsible for emptying the containers weekly and delivering the materials
to a dedicated waste bin for recyclables. The recyclable waste bin will be located inside or
adjacent to the enclosure for the parks trash dumpster. Waste Management has agreed to
collect the recyclables from the waste bins and deliver the materials to the transfer station.
The six parks scheduled to receive the new containers are Magee, Holiday, Calavera,
Poinsettia, La Costa Canyon and Stagecoach. Staff selected these parks because of their
high usage.
Staff anticipates the state will authorize payments to the City in August 2001. Installation of
the beverage containers at all six parks should be complete by the end of summer.
ENVIRONMENTAL REVIEW:
This project is categorically exempt from CEQA per section 15301 Class 1 - minor
alterations of existing public facilities and does not involve an expansion of existing
use.

FISCAL IMPACT:
The City will be reimbursed $23,593 to purchase the recycling beverage containers. No
additional staff time is needed to collect and deliver the recyclable materials because of the
proximity the recyclable containers are to the trash receptacles.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AUTHORIZING THE PUBLIC WORKS
MANAGER/GENERAL SERVICES, MANAGEMENT ANALYST, OR
DESIGNEE TO EXECUTE IN THE NAME OF THE CITY OF CARLSBAD
ALL NECESSARY FORMS FOR THE PURPOSE OF SECURING PAYMENTS AND TO IMPLEMENT AND CARRY OUT THE PURPOSES SPECIFIED IN SECTION 14581 (a)(4)(A) OF THE CALIFORNIA BEVERAGE CONTAINER RECYCLING AND LITTER REDUCTION ACT
WHEREAS, the people of the State of California have enacted the California Beverage
Container Recycling and Litter Reduction Act that provides funds to cities and counties for
beverage container recycling and litter cleanup activities; and
WHEREAS, the California Department of Conservation’s Division of Recycling has been
delegated the responsibility for the administration of the program within the State, setting up
necessary procedures for cities and counties or their designees under the program; and
WHEREAS, per Section 14581 (a)(4)(E) of the California Beverage Container Recycling
and Litter Reduction Act, the eligible participant must submit the Funding Request Form by the
due date and time in order to request funds from the Department of Conservation’s Division of
Recycling.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Carlsbad as
follows:
1. That the above recitations are true and correct.
2. That Council authorizes the submittal of the Funding Request Form to the
Department of Conservation’s Division of Recycling.

3. That the City Manager or designee is hereby authorized and empowered to execute
in the name of the City of Carlsbad all necessary forms hereto for the purposes 01
securing payments and to implement and carry out the purposes specified in the
Section 14581 (a(4)(A) of the California Beverage Container Recycling and Litter
Reduction Act and provide information regarding this program to the Department of
Conservation’s Division of Recycling upon request.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City
Council held on the 26th day Of June , 2001 by the following vote, to wit:
