RECOMMENDED ACTION:

Adopt Resolution No. (;l&)/- /q/ approving the final maps for Carlsbad Tracts CT 98-12,
Magnolia Gardens, and CT 00-05, Magnolia Gardens II, and authorizing the City Clerk to process
the maps for recording.
ITEM EXPLANATION:
Engineering staff has completed checking the final maps of Carlsbad Tract CT 98-12, also known
as Magnolia Gardens and CT 00-05, also known as Magnolia Gardens II. Even though both tracts
are contiguous, they were approved by separate discretionary action because the developer
acquired the property at different times. CT 98-l 2 is a 4.93-acre property and CT 00-05 is a 1.83-
acre property, both subdivided for residential development. These subdivisions are within Local
Facilities Management Plan (LFMP) Zone #l and are generally located north of Magnolia Avenue
between Valley Street and Highland Drive. CT 98-12 is comprised of 12 lots and CTOO-05 of 6 lots,
all single family residential lots.
The final maps conform substantially with the tentative maps as approved by City Council
Resolution No. 99-530 of December 14, 1999 for CT98-12 and by the Planning Commission on
October 18, 2000 per Resolution No. 4841 for CT 00-05. The final maps also conform to the
General Plan, all the applicable requirements of the Municipal Code, City Standards, and the Growth
Management Plan. The applicant, Loma Verde, Inc., dba Pacific Scene Homes, is requesting the
recordation of said final maps.
FISCAL IMPACT:
The developer pays a plan check fee to cover the expense of plan checking and processing the final
maps for recording. There is no fiscal impact to the City. All appropriate fees will be paid if and when
building permits are issued for this project.

RESOLUTION NO. 2001-191
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE FINAL MAP FOR
CARLSBAD TRACT 98-12, MAGNOLIA GARDENS AND
CARLSBAD TRACT 00-05, MAGNOLIA GARDENS II, AND
AUTHORIZING THE CITY CLERK TO PROCESS THE MAP FOR
RECORDING.
WHEREAS, Loma Verde, Inc., dba Pacific Scene Homes, has submitted the final maps
mown as Carlsbad Tract 98-12 and Carlsbad Tract 00-05 to the City of Carlsbad for approval;
and
WHEREAS, the City Council did on December 14, 1999 per Resolution No. 99-530
approved with conditions the tentative map for CT 98-12; and
WHEREAS, the tentative map of Carlsbad Tract 00-05 with conditions, was approved by
he Planning Commission on October 18, 2000, pursuant to Resolution No. 4841; and
WHEREAS, the Public Works Director has determined that said maps substantially
:onform to said conditionally approved tentative maps; and
WHEREAS, the conditions of approval for said final maps have been completed or
recured; and
WHEREAS, the developer has offered public street and public easements for dedication
o the City of Carlsbad; and
WHEREAS, the final maps conform to the City of Carlsbad General Plan and all
equirements of City Codes and Standards; and
WHEREAS, the City Council of the City of Carlsbad determined it to be in the public
nterest to approve said final maps.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
zalifornia, as follows:
1. That the above recitations are true and correct.
2. That said final maps known as Carlsbad Tract 98-12, Magnolia Gardens and
zarlsbad Tract 00-05, Magnolia Gardens II, which are on file with the Public Works Director and
Ire incorporated herein by reference, are accepted.
3. That the City accepts the dedications shown on the final maps.
4. That the City Clerk is authorized to sign the Certificates of Acceptance on the final
naps.

5. That the City Clerk is authorized to cause the original final maps to be recorded in
the Office of the County Recorder of San Diego County, State of California.
6. That the City Clerk is authorized to release the maps to First American Title
Company for recording in the Office of the County Recorder.
PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
held on the 26aday of June , 2001 by the following vote, to wit:
AYES: Council Members Lewis, Kulchin, Finnila, Nygaard, and Hall.
NOES: None.
