E -I- r CITY All-Y. 4E CITY hIOR- RECOMMENDED ACTION: Introduce Ordinance No. dsc5?Lf to establish a 40 mile per hour prima facie speed limit upon Alicante Road from Alga Road to its intersection with Corte de la Vista. ITEM EXPLANATION: Alicante Road is designated as a secondary arterial on the Circulation Element of the General Plan. It has a posted speed limit of 35 miles per hour that was established in 1986. The design speed for a secondary arterial is 40 miles per hour. The centerline grade on Alicante Road varies between 0.60% and 9.99%. The road has an Average Daily Traffic (ADT) volume of 6,900 vehicles near Alga Road and 2,300 in the vicinity of Corte de la Vista. Volumes are considerably less than the design volume of 10,000 to 20,000 vehicles per day for a secondary arterial. In two locations, the critical speed (85”’ percentile) was found to be 44 miles per hour. Officers in the Traffic Division of the Police Department have expressed concern about using radar to enforce speed on Alicante Road when the posted speed is nine miles per hour lower than the critical speed. Commissioners in the San Marcos Traffic Court have been dismissing citations under similar circumstances when the Engineering and Traffic Survey does not support a lowered speed limit. To avoid dismissal of citations, a 40 mile per hour speed limit would be necessary on Alicante Road. Sections 22357 and 22358 of the California Vehicle Code authorizes local authorities to establish a prima facie speed limit on the basis of the results of an Engineering and Traffic Survey. The Engineering and Traffic Survey considers such factors as the number of collisions that have occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight distance, and conditions that may not be readily apparent to the driver. At their meeting on June 4, 2001, the Traffic Safety Commission considered the results of the Engineering and Traffic Survey to revise the prima facie speed limit upon Alicante Road. The Commission recommended by a 4-1 vote to establish a 40 mile per hour prima facie speed limit upon Alicante Road from Alga Road to its intersection with Cone de la Vista. The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic Engineer. FISCAL IMPACT: Installing four speed limit signs on Alicante Road between Alga Road and Carte de la Vista will cost about $500. EXHIBITS: 1. Location Map. 2. Ns-594 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE REVISION OF SECTION 10.44.210 TO ESTABLISH A PRIMA FACIE 40 MILE PER HOUR SPEED LIMIT UPON ALICANTE ROAD FROM ALGA ROAD TO ITS INTERSECTION WITH CORTE DE LA VISTA. The City Council of the City of Carlsbad, California, hereby ordains as follows: SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended by the revision of Section 10.44.210 to read as follows: “10.44.210 Alicante Road: Upon Alicante Road from Alga Road to its intersection with Corte de la Vista, the prima facie speed limit shall be forty miles per hour.” . EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption and the City Clerk, City of Carlsbad, shall certify to the adoption of this ordinance and cause it to be published at least once in a newspaper of general circulation in the City of Carlsbad within fifteen (15) days after its adoption.
