PCH PARKS MAINTENANCE SERVICE AGREEMENT CITY MGR.~ RECOMMENDED ACTION: Staff recommends Council adopt Resolution No. $01 -&/I, amending and extending the agreement with Ponderosa Landscape Inc. for the provision of parks maintenance services. ITEM EXPLANATION The Public Works Department is responsible for maintaining the various park facilities and City office landscape locations throughout the City. Public Works has determined that the use of a contractor to provide basic maintenance services allows a higher level of service overall with increased staffing at major park sites. I With the addition of several new locations requiring grounds maintenance, and the increased cost of maintaining all areas (e.g., energy costs), payments to the contractor have increased beyond 25% of the original agreement pricing. This places the approval of additional amendments and extensions beyond the approval authority of the City Manager. With the approval of the attached amendment, monthly payments to the contractor will rise to $10,781.80 per month. Please see Exhibit “A” to the amendment for details of pricing and areas covered by the agreement. I FISCAL IMPACT No unbudgeted impact is expected. These services are a planned part of the Public Works annual budget. WHEREAS, the City of Carlsbad requires the services of a parks maintenance contractor, and; WHEREAS, due to additions of areas maintained and increasing costs of operations, contract payments to the current contractor will exceed the level of City Manager approval; and WHEREAS, Ponderosa Landscape, Inc. is our current parks maintenance contractor: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad as follows: 1. The Mayor of the City of Carlsbad is hereby authorized to execute the attached ratification of amendment and extension to the original agreement with Ponderosa Landscape, Inc.. 2. The Purchasing Officer is hereby authorized to encumber funds in the amount necessary to match approved expenses. ABSENT: None. . ATTEST: (SEAL) / RATIFICATION OF EXTENSION AND AMENDMENT NO. 4 TO AGREEMENT FOR PARKS MAINTENANCE SERVICES PONDEROSA LANDSCAPE INC. This Ratification of Extension and Amendment is entered into the 1st day of August ) 2001 but effective as of the IS’ day of July, 2001, ratifying the extension and amending the Agreement dated July 15, 1998, by and between the City of Carlsbad, a municipal corporation, hereinafter referred to as “City” and Ponderosa Landscape Inc., hereinafter referred to as, “Contractor” br parks ,maintenance se&es. RECITALS WHEREAS, the Agreement, as amended, expired on June 30, 2001, and the Contractor continued to work on needed services without benefit of agreement; and WHEREAS, the City and Contractor desire to ratify the extension of the term of the Agreement and any amendments thereto for a period of one (1) year ending on June 30. 2002, and WHEREAS, the Agreement, identified a scope of work which includes the work described in the original agreement and three pretious amendments; and WHEREAS, the parties to the Agreement desire to alter the scope of work as follows: increase fees by 5% for current work locations; and WHEREAS, a supplemental scope of work and fee schedule have been negotiated and agreed to between the parties and is attached hereto and incorporated herein by reference as Exhibit “A” Scope of Services and Fee; and WHEREAS, the City and Contractor desire to ratify any amended scope of work already performed; NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, City and Contractor hereby agree as follows: 1. The retroactive extension and amendment of the Agreement is ratified. 2. The term of the Agreement shall end on June 30,2002, Revised 02/04/00 3. Contractor shall protide services as outlined on the attached Exhibit “A”. 4. City shall pay Contractor for all work associated with Paragraph 1 above, on a time and materials basis not-to-exceed a total of $ 10,781.80 per month. Contractor shall provide City, on a monthly basis, copies of invoices sufficiently detailed to include hours performed, hourly rates, and related activities and costs for approval by City. 5. All other provisions of the Agreement and any amendments thereto shall remain in full force and effect. 6. All requisite insurance policies to be maintained by the Contractor pursuant to the Agreement and any amendments thereto shall be extended to include coverage for the extension period.
