ENG PROJECTS NO. 36441,35871,38591 CITY MGR. ti RECOMMENDED ACTION: Adopt Resolution No. 200 I-213 appropriating $159,500 from the Public Facilities Fee (PFF) fund and authorizing the Finance Director to reimburse Continental Ranch, Inc. $351,676 for the installation of traffic signals at the Palomar Airport Road and Melrose Drive, Alga Road and Melrose Drive and Poinsettia Lane and Melrose Drive intersections, and pay GVP Consultants $3,000 for reimbursable auditing expenses. ITEM EXPLANATION: Circulation Mitigation measures B.2.d, B.l .b and B.2.e of the Zone 18 Local Facilities Management Plan (LFMP) require the construction of traffic signals at the Palomar Airport Road and Melrose Drive, Alga Road and Melrose Drive, and Poinsettia Lane and Melrose Drive intersections. Palomar Airport Road, Melrose Drive, Alga Road and Poinsettia Lane are all Circulation Element Streets, and all three traffic signals are included in the City’s Capital Improvement Program (CIP). Therefore Continental Ranch, Inc. is eligible for reimbursement for the construction and related costs. FISCAL IMPACT: Palomar Airport Roadhlelrose Drive On June 27, 1997, Continental Ranch, Inc. awarded a contract to Sim J. Harris Company including the amount of $105,629 for the construction of a traffic signal at the Palomar Airport Road and Melrose Drive intersection. Subsequent change orders increased the contract amount to $109,994. A qualified auditing engineer, GVP Consultants, was retained by the Engineering Department to review and analyze the reimbursable expenses. The audit report makes allowances for non-labor and non-materials reimbursable costs for design, project management, mobilization, plancheck, inspection and bonding. GVP Consultants advised that reimbursable expenses for the traffic signal total $129,902. Through the CIP, the City Council appropriated $125,000 in Public Facility Fee (PFF) funds for the installation of this traffic signal, which is the maximum reimbursement allowed, as stated in the Zone 18 LFMP. No additional appropriations are required as shown in Table 1 below. A change order increased the contract amount to $95,050. The GVP Consultants audit report indicates $112,254 of reimbursable expenses for this traffic signal after allowing for non-labor and non-material expenses. The City Council appropriated $110,000 in PFF funds for the construction of this traffic signal, which is the maximum reimbursement allowed, as stated in the Zone 18 CFMP. A subsequent contract with Sim J. Harris increased the total for the Poinsettia Lane/Melrose Drive traffic signal to $100,488. The GVP Consultants audit report indicates $118,676 of reimbursable expenses for this traffic signal after allowing for non-labor and non-material expenses. The CIP budget contains $125,000 in 2005-2010 for the construction of this traffic signal. Staff recommends that $119,676 of PFF funds be appropriated in the current year for this traffic signal as shown in Table 3 below. PROJECTS NO. 36441,35871,38591 WHEREAS, installation of traffic signals at the intersections of Palomar Airport Road and 7 Melrose Drive, Alga Road and Melrose Drive, and Poinsettia Lane and Melrose Drive were 8 mitigation measures of the Zone 18 Local Facilities Management Plan (LFMP); and 9 WHEREAS, the financing matrix of the Zone 18 LFMP indicated that reimbursements 10 would be paid through appropriated Public Facilities Fee (PFF) funds; and 11 WHEREAS, Continental Ranch, Inc. installed said traffic signals; and 12 WHEREAS, Continental Ranch, Inc. requests reimbursement in the amount of $360,832 ,3 for the installation of said traffic signal: and WHEREAS, an audit was conducted for a reimbursable fee in the amount of $3,000 and 14 the Public Works Director approves total reimbursement including the audit fee in the amount of 15 $354,676: and 16 l7 WHEREAS, there is currently $195,500 available for reimbursement in the City’s Capital Improvement Program (CIP) through Public Facilities Fees (PFF) for the installation of said traffic l8 signals, referenced as CIP Projects No. 36441 and 35871; and 19 WHEREAS, the Public Works Director requests that the City Council authorize the XI Finance Director to reimburse Continental Ranch, Inc. in the amount of $351,676 for the 21 installation of said traffic signals and reimburse GVP Consultants in the amount of $3,000 for auditing expenses. 22 23 24 25 26 reimburse Continental Ranch, Inc. for the installation of traffic signals at the intersections of I NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, ’ California, as follows: 1. That the above recitations are true and correct. 2. That the Finance Director is hereby authorized to appropriate funds from the PFF fund in the amount of $39,500 to the Alga Road/Melrose Drive traffic signal account (Project No. 35871) and $119,676 to the Poinsettia Lane/Melrose Drive account (Project No. 38591). 4. That following the appropriation of funds the Finance Director is hereby authorized to reimburse Continental Ranch in the amount of three hundred fifty-one thousand, six hundred seventy six dollars ($351,676) for the installation of traffic signals at the intersections of Palomar Airport Road and Melrose Drive, Alga Road and Melrose Drive, and Poinsettia Lane and Melrose Drive. 5. That following the appropriation of funds the Finance Director is hereby authorized to pay the auditing engineer, GVP Consultants the amount of three thousand dollars ($3,000) for reimbursable auditing costs in connection with traffic signals at the intersections of Palomar Airport Road and Melrose Drive, Alga Road and Melrose Drive, and Poinsettia Lane and Melrose Drive. PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council II held on the 24th day of July , 2001 by the following vote, to wit: lchin, Finnila, Nygaard, and Hall. LORRAINE M.
