I 3829 AND 3810 AND APPROPRIATION OF FUNDS ENG CITY MGR. $% I RECOMMENDED ACTION: Adopt Resolution No. &@ oI-317 accepting bids and awarding the construction contract for the Poinsettia Lane Overhead Widening, Project Nos. 3551, 3442, 3829 and 3810 to Herzog Contracting Corporation and appropriation of funds. I ITEM EXPLANATION: The Poinsettia Lane Overhead Widening project consists of the widening of the Poinsettia Lane bridge over the San Diego Northern Railroad tracks as well as roadway, water, recycled water and sewer system improvements between Carlsbad Boulevard and Avenida Encinas. As a result of the project, Poinsettia Lane including the bridge over the tracks will be constructed to the ultimate configuration in accordance with the Circulation Element of the General Plan. Construction is anticipated to require approximately one hundred sixty (160) working days from the date of issuance of the Notice to Proceed to the contractor. The Engineer’s Estimate for construction for the project was $1,386,000. On May 17, 2001, City Council authorized the advertisement for bids for construction. The Purchasing Department received eight (8) sealed bids on June 7, 2001 as shown in Table 1. TABLE I- CONSTRUCTION BIDS The total bid was the sum of five separate bid schedules. Schedule B included the items of work related to the construction of the bridge. All bids received for Schedule B exceeded the Engineer’s Estimate. The average bid received for Schedule B was $872,435 compared to the Engineer’s Estimate of $546,377. A review of the bids indicates that the Engineer’s Estimate did not accurately predict the additional costs associated with the inefficiencies of constructing within the railroad right-of-way. Typical inefficiencies are created by having to maintain clearance from the tracks and the need to move and reset cranes more than would otherwise be needed. The plans do not contain significant discrepancies or ambiguities that contributed to the cost exceeding the Engineer’s Estimate. Subsequent to the bid opening, Wier Construction Corporation discovered an error in the price they bid for the bridge widening item of work. Backup information submitted by Wier Construction Corporation indicated that a clerical error resulted in a bid that was $166,050 lower than intended. After a review of the backup information submitted, Wier Construction Corporation was allowed to withdraw their bid based on the significant clerical error. After the withdrawal of Wier Construction Corporation, the apparent low bidder is Herzog Contracting Corporation. All bid documents submitted by Herzog Contracting Corporation have been reviewed by staff and found to be in order. Page 2 of Agenda Bill No. \ b .r %?? ENVIRONMENTAL: The Planning Commission approved a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program for the project on January 5, 2000. The financing, bidding, and construction of the project would not create any additional environmental impacts that have not otherwise been evaluated and considered during the issuance of the documents noted above. FISCAL IMPACT: The total estimated construction costs associated with the project is $2,032,763 as summarized in Table 2. TABLE 2- CONSTRUCTION COST OVERVIEW The funding sources for the various project components are as follows: 0 Bridge and Roadway - Public Facilities Fees a Water System - Water Connection Fees 0 Recycled Water System - Recycled Water Connection Fees 0 Sewer System - Sewer Replacement Funds To provide sufficient funds for the Bridge and Roadway construction contingency, inspection and testing services staff is recommending the appropriation of an additional $131,358 in Public Facilities Fee funds. WHEREAS, plans and specifications have been approved by the City Council of the City of Carlsbad for the construction of the Poinsettia Lane Overhead Widening, Project Nos. 3551,3442,3829, and 3810; and WHEREAS, the low bid received to construct said project was submitted by Wier Construction Corporation in the amount of $1,571,144.23; and WHEREAS, the low bid received from Wier Construction Corporation has been withdrawn and as such is not responsive; and WHEREAS, the second low bid received to construct said project was submitted by Herzog Contracting Corporation in the amount of $1,627,374; and WHEREAS, the second low bid received to construct said project submitted by Herzog Contracting Corporation is responsive; and WHEREAS, there are sufficient funds appropriated for the Sewer, Water and Recycled Water components of the project; and WHEREAS, the total estimated construction costs for the Bridge and Roadway project component are $1,687,598; and WHEREAS, to fund the Bridge and Roadway component of the project requires additional appropriations in the amount of $131,358 from the Public Facilities Fees fund. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the Finance Director is authorized to appropriate additional funds in the amount of $131,358 from the Public Facilities Fees fund to the Bridge and Roadway project component account. 3. That the bid of $1,627,374 by Herzog Contracting Corporation for the Poinsettia Lane Overhead Widening, Project Nos. 3551, 3442,3829, and 3810 is accepted, and the Mayor is hereby authorized to execute a contract therefor. 1 4. That the City Manager is hereby authorized to approve construction change 2 orders up to $165,389. 3 5. That the award of this contract is contingent upon Herzog Contracting Corporation 4 executing the required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) days of adoption of this resolution.
