RECOMMENDED ACTION:

Adopt Resolution No. ao” ‘*a/ 1 to approve initiation of process for annexation and
detachment between Carlsbad’s Sewer Service Area and Leucadia County Water District for
La Costa Greens (CT 99-03).
ITEM EXPLANATION:
The La Costa Greens development (CT 99-03) is located north of Alga Road and east of El Camino
Real. The sewer service boundary crosses CT 99-03 such that the northerly portion is in the City of
Carlsbad’s sewer service area and the southerly portion is in Leucadia County Water District
(LCWD) as shown in Figure 1. The developer of CT 99-03, Morrow Development, has prepared studies on file with the City’s Engineering Department, showing that to cost-effectively provide sewer service to the development requires that the sewer service area boundary be adjusted. Morrow Development is requesting that the sewer service boundary between the City of Carlsbad and LCWD be adjusted as shown on Figure 2, reflecting the following changes in the service area and development units.
The Engineering staff has reviewed the reports submitted by Morrow Development and concurs in their findings. LCWD has also reviewed the reports prepared by Morrow Development and concurs in their findings.
ENVIRONMENTAL IMPACT:
This action is exempt from CEQA in accordance with Section 15061, Review for Exemption. There is no possibility that the activity in question may have a significant effect on the environment.
FISCAL IMPACT:
There is no fiscal impact to the annexation and detachment process. Morrow Development will be
paying all Local Agency Formation Commission (LAFCO) processing fees. However, CT 99-03 is
located in Sewer Benefit Area “H”. There will be a net loss of 57 equivalent dwelling units tributary to Sewer Benefit Area “H”. As a result, there will be a need to modify the equivalent dwelling unit fee amount collected for Sewer Benefit Area “H”. The Sewer Benefit Area “H” fee is based on 4,836 EDU’s. Therefore, a reduction of 57 EDU’s is considered a minor adjustment from the total.

CARLSBAD, CALIFORNIA, TO APPROVE INITIATION OF PROCESS
FOR ANNEXATION AND DETACHMENT BETWEEN THE CITY OF
CARLSBAD’S SEWER SERVICE AREA AND LEUCADIA COUNTY
WATER DISTRICT FOR LA COSTA GREENS (CT 99-03).
5 WHEREAS, Morrow Development is the developer of CT 99-03 located in the City of
6 Carlsbad; and
7 WHEREAS, Morrow Development has prepared studies to show that the sewer service
8 boundary affecting CT 99-03 needs to be adjusted between the City of Carlsbad and
g Leucadia County Water District to cost-effectively provide sewer service to CT 99-03; and
10 WHEREAS, Morrow Development is requesting that the City of Carlsbad concur with
,, Morrow Development in initiating the process of annexation and detachment of certain property
within CT 9903 between the City of Carlsbad and the.Leucadia County Water District. 12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
13 California, as follows:
14 1. That the above recitations are true and correct.
15 2. That the City of Carlsbad does not object to the annexation and detachment
16 of certain property within CT 99-03 between the City of Carlsbad’s sewer service area and
l7 Leucadia County Water District.
18 3. That processing of the annexation and detachment will be pursued through
19 the Local Agency Formation Commission (LAFCO) and all costs for the LAFCO process shall be
paid by Morrow Development.
20 PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
21 held on the 24th day of July I 2001 by the following vote, to wit:
22 Finnila, Nygaard, and Hall.
