HD. d CITY ATTY. & ’ CITY MGRa RECOMMENDED ACTION: That the City Council AUTHORIZE the Mayor to execute agreements with Dawson West, McCabe and Company, and Fox and Sohagi to assist the City with various aspects of processing and funding City capital projects. AND ADOPT REISOLUTION NO. 2001-243. ITEM EXPLANATION: The current Federal and State regulatory environment entails significant processing issues for City capital projects. There are frequently multiple layers of review and permitting through different agencies, such as the U.S. Fish and Wildlife Service, the California Department of Fish and Game, the Army Corps of Engineers, the Regional Water Quality Control Board, and the California Coastal Commission. In some cases there are conflicts or inconsistencies between the laws and requirements of the different agencies. The City is currently faced with these processing issues on almost every project, and staff does not foresee relief in the immediate future. At the same time, the City is embarking on the most ambitious Capital Improvement Program in its history. An unprecedented number of projects are to be constructed in the next five years to satisfy both Growth Management requirements and citizen desires. Many of these projects are large, complex and expensive. Timing is also an important factor, and most projects have aggressive schedules for completion. A staff committee called the Future Park and Road Organizing Group (FPROG) has been formed to expedite these larger, more complex projects. Given the list of projects and the intricacies of their processing and funding, the FPROG committee has requested outside help in order to keep the projects on schedule and within their budgets. This agenda bill is the result of that request. Staff has been in contact with three firms who provide the different types of services needed at this time. FPROG is recommending that all three be retained. The City has had positive experiences with the principals of the firms, and they are uniquely positioned to be able to assist the City at this time. Dawson West consults on federal matters and is headed by former Congressman Ron Packard. McCabe and Company consults on state matters, particularly items relating to the California Coastal Commission. Susan McCabe is a former Coastal Commissioner. Fox and Sohagi is a law firm specializing in environmental matters. Margaret Sohagi has assisted the City in the past, and the City Attorney has recommended retaining her for continued assistance. It is recommended that the City enter into retainer agreements with these firms in order to have their assistance on multiple projects as the need arises. Initially we would anticipate having the firms assist the City in determining whether final federal approval of the Habitat Management Plan (HMP) can be achieved. Legislative solutions would receive early consideration because they do not require the City to exhaust its administrative remedies. Whether or not the HMP is approved, staff anticipates that the assistance of the firms will be needed on permitting individual projects. In addition to assistance in permit processing, the firms would be expected to assist with federal and state funding for qualifying projects. A few of the larger projects are shown in the table below along Nith their approximate value. The magnitude of these projects shows that the judicious use of consultants to ensure project success is a worthwhile investment. PAGE 2 OF AGENDA BILL NO. ! /g ! 3 1 0 Project Approximate Value FISCAL IMPACT: If the City Council approves the recommendation, standard consultant agreements, approved as to form by the City Attorney, will be executed for fixed cost retainers. The cost of the Dawson West services would be $103,000 per year. The cost of the McCabe and Company Services would be $45,000. The cost of the Fox and Sohagi services would be $25,000. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the Mayor is hereby authorized to enter into standard City consulting agreements with Dawson West, McCabe and Company, and Fox and Sohagi. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Carlsbad on the 7th day of Auqust 2001, by the following vote, to wit: AYES: Council Members Lewis, Kulchin, Nygaard and Hall.
