PW FOR STREET SWEEPING SERVICES WITH CANNON PACIFIC SERVICES RECOMMENDED ACTION: Adopt Resolution No. a m\ - a 75 approving Amendment No. 6 with Cannon Pacific Services for street sweeping services to increase service from twice monthly to weekly on the heavily traveled roadway segments, and authorizing the City Manager to execute same. ITEM EXPLANATION: As part of the effort to comply with NPDES requirements, staff submitted a recommendation for enhanced street sweeping services on six heavily traveled roadway segments, as follows: l El Camino Real from Haymar Drive to the southern city limits l Palomar Airport Road from Carlsbad Boulevard to the eastern city limits l La Costa Avenue from Interstate 5 to Ranch0 Santa Fe Road l Paseo del Norte from Cannon Road to Palomar Airport Road l Tamarack Avenue from Carlsbad Boulevard to Carlsbad Village Drive l Marron Road from Highway 78 to El Camino Real This recommendation and corresponding funding was incorporated into the NPDES Municipal Facility Component goal, and subsequently approved. FISCAL IMPACT: The total additional cost required for the enhanced service level is $24,000 annually. WHEREAS, Cannon Pacific Services has provided street sweeping services in the City since September, 1997; and WHEREAS, the City has deemed it desirable to enhance street sweeping service levels on heavily traveled roadway segments; and WHEREAS, The City and Cannon Pacific Services have negotiated the scope of work, terms, and conditions of the enhanced service levels. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. Amendment No. 6 to the Agreement for Street Sweeping Services between the City of Carlsbad and Cannon Pacific Services attached hereto as Exhibit “A” is hereby approved. 3. The City Manager is hereby authorized to execute said Amendment on behalf of the City. (SEAL) AMENDMENT NO. 6 TO AGREEMENT FOR STREET SWEEPING SERVICES Cannon Pacific Services This Amendment No. 6 is entered into and effective as of the September 20th day of 2001, amending the agreement dated September 3, 1997 (the “Agreement”) by and between tie City of Carlsbad, a municipal corporation, (“City”), and Cannon Pacific Services, (“Contractor”) (collectively, the “Parties”) for street sweeping services. RECITALS A. On May 11, 1998, the Parties executed Extension and Amendment No.1 to the Agreement to add public parking lots to the scope of service, adjust the fee schedule for CPI increases, and extend the term for one additional year; and B. On April 21, 1999, the Parties executed Extension and Amendment No. 2 to the Agreement to adjust the fee schedule for CPI increases and extend the term for one additional year; and C. On August 23, 1999, the Parties executed Amendment No. 3 to the Agreement to add additional parking lots to the scope of service; and D. On April 21, 2000, the Parties executed Extension and Amendment No. 4 to the Agreement to adjust the fee schedule for CPI increases and extend the term for one additional year; and E. On May 22, 2001, the Parties executed Extension and Amendment No. 5 to the Agreement to adjust the fee schedule for CPI increases and extend the term for one additional year; and F. The Parties desire to alter the Agreement’s scope of work to increase street sweeping services from twice monthly to weekly on specified roadway segments; and NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, City and Contractor agree as follows: 1. In addition to those services contained in the Agreement, as may have been amended from time to time, Contractor will increase service from twice monthly to weekly on the following roadway segments: l El Camino Real from Haymar Drive to the southern city limits l Palomar Airport Road from Carlsbad Boulevard to the eastern city limits l La Costa Avenue from Interstate 5 to Ranch0 Santa Fe Road l Paseo del Norte from Cannon Road to Palomar Airport Road l Tamarack Avenue from Carlsbad Boulevard to Carlsbad Village Drive l Marron Road from Highway 78 to El Camino Real 2. City will pay Contractor for all work associated with those services described in Paragraph 1 $2,000 per month. Contractor will provide City, on a monthly basis, copies of invoices sufficiently detailed to include hours performed, hourly rates, and related activities and costs for approval by City. All requisite insurance policies to be maintained by Contractor pursuant to the Agreement, as may have been amended from time to time, will include coverage for this Amendment. 5. The individuals executing this Amendment and the instruments referenced in it on behalf of Contractor each represent and warrant that they have the legal power, right and actual authority to bind Contractor to the terms and conditions of this Amendment.
