THE CONSTRUCTION OF ATG. 9/I l/O1 2000/01 PAVEMENT OVERLAY PROJECT

RECOMMENDED ACTION:
Adopt Resolution No. 900 I-akj accepting bids and awarding the contract to Nicholas Grant
Corp. for the construction of the 2000/01 Pavement Overlay Project, Project No. 3667-4.
ITEM EXPLANATION:
The 2000/01 Pavement Overlay Project is part of the City’s ongoing Pavement Maintenance
Program. Streets selected for this project are generally older streets with considerable wear and/or
cracking (see Exhibit 1). Approximately eight miles of roadway will receive a pavement overlay.
In addition to the pavement overlay, the construction on some of the streets will include curb and
gutter, gutter drains, driveway aprons and full depth pavement section reconstruction.
The engineer’s construction cost estimate for this project was $2,220,000.
On August 9, 2001, four (4) sealed bids were received for the construction of this project as shown
on Table 1:

With a bid of $2,038,387, Nicholas Grant Corporation is the lowest responsive bidder.
All bid documents submitted by Nicholas Grant Corporation have been reviewed by staff and found
to be in order.
ENVIRONMENTAL COMPLIANCE:
This project is categorically exempt from the environmental review process under Section 15301
Class 1 (C) of the California Environmental Quality Act.
FISCAL IMPACT:
The estimated construction costs associated with the project is $2,344,145 as summarized in
Table 2.

The funding for this project, which has been appropriated, comes from TransNet-Local Increment,
Gas Tax and AB 2928 as summarized in Table 3. AB 2928, also known as the Traffic Congestion
Relief Act of 2000, is a new source of State funding for transportation projects.

RESOLUTION NO. 2001-281
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A
CONTRACT FOR THE CONSTRUCTION OF THE 2000/01
PAVEMENT OVERLAY PROJECT, PROJECT NO. 3667-4 TO
NICHOLAS GRANT.
WHEREAS, on June 5”, 2001 the City Council of the City of Carlsbad approved plans for
the construction of the 2000/01 Pavement Overlay Project, Project No. 3667-4; and
WHEREAS, four (4) sealed bids were received on August 9, 2001 by the City of Carlsbad
for the construction of said project; and
WHEREAS, the low bid to construct said project was submitted by Nicholas Grant
Corporation in the amount of $2,038,387; and
WHEREAS, the low bid to construct said project submitted by Nicolas Grant Corporation is
responsive; and
WHEREAS, the total estimated cost to complete this project is $2,344,145 (which includes
construction, project management, inspection, and construction contingencies); and
WHEREAS, there are sufficient funds available to complete the project; and
WHEREAS, subsection 3.28.172(c)(l) of the Carlsbad Municipal Code authorizes the
City Manager to approve change orders in the amount equal to the contingency.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That, the low bid of $2,038,387 submitted by Nicholas Grant Corporation for the
construction of the 2000/01 Pavement Overlay Project, Project No. 3667-4, is accepted and
the Mayor is hereby authorized to execute a contract with Nicholas Grant Corporation for
Project No. 3667-4.
3. That the City Manager is hereby authorized to approve construction change orders

to $203,839.
1 4. That the award of this contract is contingent upon the bidder submitting the lowest
2 responsive bid executing the required contract and submitting the required bonds and insurance
3 policies, as described in the contract, within twenty (20) days of adoption of this resolution.
4 The City Manager may grant reasonable extensions of time.
5 PASSED, APPROVED AND ADOPTED at a regular meeting of the Carlsbad City Council
6 held on the 18th day of September , 2001 by the following vote, to wit:
7 AYES: Council Members Lewis, Kulchin, Finnila, and Hall.
