ENG PROJECT NO. 3184 RECOMMENDED ACTION: Adopt Resolution No. WI- aqv approving an agreement with San Diego Gas and Electric (SDG&E) for the relocation of a transmission line. ITEM EXPLANATION: Cannon Road West Reach 2 Segment 2 (Segment 2)‘ which will extend Cannon Road to El Camino Real, is proposed to start construction in September 2001. The project requires the relocation of a SDG&E transmission line located within the Segment 2 alignment. Kelly Land Company (KLC) has been conditioned to construct Segment 2. Segment 2 is funded through Bridge and Thoroughfare District No. 3 (BTD). The BTD funds all improvements required to grade the full roadway right-of- way. The Segment 2 project required the relocation or reconstruction of several SDG&E facilities. Since SDG&E has prior rights over the easements, the City must pay for the relocation costs of the transmission line. The original fee letters were provided in 1998 and 1999. Detailed information regarding these facilities is included in the attached Table A. KLC planned to piggy back the construction of Segment 2 after completing the Segment 1 improvements. However, the California Coastal Commission appealed the tentative map and related discretionary actions after approval by the City Council. This appeal delayed the construction of the roadway for several years. The power pole relocation requires the grading of a pad outside of the right-of-way. This grading is part of the Kelly Ranch Core project by KLC. In the last few years, costs associated with constructing the new power pole have escalated. In addition, costs incurred in the construction of the other facilities exhausted the funds provided to SDG&E previously. The cost estimate to complete the two-pole structure is $43,686. The City has previously paid SDG&E $231,965 for the design and relocation or reconstruction of facilities located within the Cannon Road West alignment. Staff recommends approving the agreement with SDG&E to relocate the power pole. ENVIRONMENTAL IMPACT: The Planning Director has determined that the requested action is consistent with prior CEQA review. The project was reviewed in the Cannon Road Reach 1 Environmental Impact Report, the Kelly Ranch Environmental Impact Report and the Mitigated Negative Declaration for Reach 2. Significant environmental impacts identified by those CEQA documents were determined to be mitigable to levels of less than significant. Permits from the resource agencies have been received. FISCAL IMPACT: The estimated cost for the relocation of the two-pole structure is $43,686. Totals costs for the relocation or reconstruction of all SDG&E facilities are $275,671. The BTD anticipated a cost of $333,259 for the relocation or reconstruction of all SDG&E facilities. Sufficient funds are available in the project account. WHEREAS, the City Council of the City of Carlsbad, California has reviewed the need for the relocation of the San Diego Gas and Electric transmission lines and determined it to be in the best interest of the Cannon Road project to relocate the transmission line with the Cannon Road grading; and WHEREAS, a mutually satisfactory agreement for the relocation has been negotiated with San Diego Gas and Electric Company agreement (the “Agreement”); and WHEREAS, the City Council recognizes the need to have the transmission line relocated; and 13 WHEREAS, the project is in full compliance with the California Environmental Quality I4 Act; and 15 WHEREAS, the Agreement with San Diego Gas and Electric has been prepared and 16 submitted hereto; and 17 WHEREAS, it is in the best interest of the City to approve the Agreement. 16 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 1g California, as follows: 20 21 1. WOOD, Cit$&lerk (SEAL) SEP-04-2001 09: 49 CITY OF CRRLSBFID 760 431 5769 P.02/11 AGREEMENT FOR TRANSMISSION LtNE RELOCAltON CANNON ROAD WEST REACtI 2 PROJECT NO. 3184 THJS AGREEMENT is made and entered into this 2nd day Of October , 2001, by and between the City of Cartsbad, a municipal corporation, hereinafter referred to as “City” and San Diego Gas and Electric Company, hereinafter referred to as “SDG&E”, regarding the foliowing facts: WHEREAS, City is directing as a public works project, certain road improvements for Cannon Road West Reach 2; and WHEREAS, SDG&E has existing transmission facilities, being a (1) two-pole structure, within the Cannon Road right-of-way; and WHEREAS, an element of the Improvements is the Relocation of the (1) two-pole structures; and WHEREAS, City has requested SDG8E conduct this Relocation incident to the Improvements; and WHEREAS, because said Relocation is to be accomplished within an area of Prior Rights and not within an area subject of the franchise, City will be responsible for all costs associated therewith; and WHEREAS, City will agree to pay for the Relocation; and WHEREAS, SDGBE will agree to effect the Relocation pursuant to the City’s request; and WHEREAS, the estimated cost of the Relocation portion of the public works Improvement is more than $25,000 and, therefore, the approval of the City Council is required. Transmission. Line Relocation a. Specifications. SDG&E shall relocate the (1) two-pole structure and complete associated line work pursuant to the plans and specifications as sat forth in SIX&E Work Order No. 713868-640. b. Timing of Work. CITY, by and through its Engineering Department, is coordinating the Improvements. SDG&E estimates that the Relocation will require approximately forty (40) working days after the execution of this agreement to comptete, and SDG&E will utilize its best efforts to so complete the Relocation; provided, however, CITY and SDG&E acknowledge and agree that certain events and occurrences can disrupt the contemplated schedule including, but not limited to, the requirement or need not to otherwise curtail the electric supply throughout the SDG&E service territory, timely approval by the CA IS0 for the associated line outage, weather, work stoppages or the discovery of unforeseen conditions in the fietd which cause revisions or modifications to the plans for the Relocation and/or Improvements. SDGdE wifl commence the Relocation within a reasonable time after notification from the CITY that CITY is ready to have the Relocation portion uf the Improvements begun and will diligently pursue the completion of the work. c. Payment. SDG&E has estimated the cost of the Retocation to be $43,086, which estimate includes contractor’s charges, equipment and materials, SDG&E personnel and employee labor and engineering charges including labor additives. Upon compMion of th8 Relocation, SDGLE shall, consistent with past practices between CITY and SDG&E for the payment of utifity Relocation charges, provide CITY with an accounting of the costs incurred by SDG&E for labor, material and equipment to complete the Relocation. If the costs for the Relocation are less than the estimated charges, SDCXE shall remit to the CITY, together with the accounting, SW&E’s check payable to CITY for the difference. .If the costs of the Relocation are more than the estimated charges, the accounting so provided shall be deemed an additional invoice from SDG&E to CITY, and CITY shall remit to SDG&E the balance due within thirty (30) days of the CKY’s receipt of the accounting/Invoice. Differences of less than $75.00 will not be billed or refunded. SDGBE represents to ClTY that as a matter of practice, SDG&E maintains records which adequately and accurately show the actual costs which are contemplated to be incurred for this Relocation for a period of three (3) years following compfetion of the Relocation. 2. Responsibility for Relocation The Relocation shall be accomplished by SDG&E at its sole direction and in compliance with such rules and orders governing design, construction and maintenance of transmission lines a6 promulgated by the Public Utilities Commission of the State of California. Affirmation of SDG&E Prior Riahts Nothing in this agreement shall be construed in any way to alter, modify, or terminate any prior rights of SDG&E within the area of the Relocation, the Improvements, or the area of Prior Rights from which the existing portions of the transmission line is to be relocated. 4. Cancellation of &reement In the event the CITY shall cancel or modify the improvements of which the Relocation subject of the Agreement is a part, and the result of such cancellation or modification in the elimination of the Relocation from the Improvements altogether, CIN may thereupon terminate this Agreement upon written notice thereof from CIN to SIX&E. In the event this Agreement is so terminated, CITY shall nonetheless be responsible and liable to SDG&E for alI costs incurred by SDG&E for the Relocation up to and including the date of the termination, including any cancellation or penalty charges which SDG&E may incur from any of its contractors or subcontractors. Upon receipt of notice of termination, CITY and SCKXE shall implement the accounting and payment adjustment procedures described in paragraph 1 (c) hereof. 5. c This Agreement shall be effective upon signature hereon by the Mayor of the City of Carlsbad, pursuant to a Resolution of adoption by the City Council of the City of Carl&ad. 6. Entire Aareement This Agreement constitutes &he entire agreement between the CITY and SDG&E relating to the subject matter hereof. Any agreements or representations not speciftcally set forth herein are void and of no force or effect; any modifications or amendments to this Agreement shall furthermore be of no force or effect unless set forth in a writing signed by both parties. Notices Any notice, invoice or other communication that either party may or is required to give the other shall be in writing, shall be personally delivered, transmitted by facsimile, or by U. S. Mail, regular delivery. Notices are deemed received on the same day if by personal delivery or by facsimile, and upon the third day after mailing if defivered by mail. The original job (713868-010) cost estimate of $79,629.99 was to relocate two-twin transmission poles. The design and costs were calculated two years prior to actual construction and not updated to reflect current costs. The costs actually had increased thus accounting for some of the discrepancy between the actual and quoted costs. The first two-pole structure was relocated per plan. However, a change was made to the design to accommodate additional work around the second two-pole structure. This location would require “surcharge” or fill, settle & re-compact. Thus postponing the second relocation until now. SDG&E has calculated the cost to complete the (713868-040) second two-pole structure at $43,686.00. See attached note from Allen Sojourner. There was also 1 steel transmission pole relocation (605166-040) required to accommodate the improved Cannon Rd. with a cost estimate of $145,477.63. Upon completion of work the City will receive a final accounting of work completed and will either be billed or credited any differences between the actual and estimated costs. Your cost, as cited herein, are subject to change at any time. All cost calculations are based upon SDG&E’s filed tariffs, SDG&E’s internal costs, and all applicable governmental or regulatory statutes, regulations, codes and rules. Should any change in, or addition to, those tariffs, costs, statues, or regulations, codes or rules in any way impact these cost calculations, you will be subject to any resulting increase or decrease. After we complete the work, we will determine the actual cost of the job. Should the job cost more than the estimate you will be billed the difference. If the job is less than the estimate, we will refund the difference to you. Differences of less than $75.00 will not be billed or refunded. The following sections describe the estimated costs (Construction Fee), project scope and schedule for constructing the project. Transmission Engineering has completed the preliminary engineering and design to relocate one 2-pole structure. CONSTRUCTION COSTS: The estimated construction fee is $43,686.00. This fee will provide for construction of the project based on the project scope and schedule described below. This cost is in addition to all previously collected engineering and material fees. SCOPE: This project is required to accommodate the city’s proposed grading in our existing right-of-way along Tie Line 13802. The project requires relocating one 138kV two-pole structure. I SCHEDULE: The following project schedule is based on the information currently available. TASK EXPECTED COMPLETION 1. Issue Construction Bid Package Two - Four weeks after receipt of construction fee. 2. Begin Construction Two - Four weeks after contract award. 3. Complete Construction Two - Four weeks after start of construction. SIX&E will attempt to accommodate the customer’s schedule whenever possible, contingent on site availability, other wotkloads, material delivery, outage approval by the Independent System Operator (ISO) and other factors not controlled by SDG&E. In the event that the scope of the project changes, the schedule and cost will be impacted. This is an estimate only, the developer will pay Actual Cost Billing. SDG&E will refund overestimated costs, and will bill the customer for any underestimate.
