ENG CITY OF CARLSBAD -AGENDA BILL TITLE- -- APPROVE AND AUTHORIZE AMENDMENT NO. 1 TO AGREEMENT WITH AMEC EARTH & ENVIRONMENTAL FOR MUNICIPAL FACILITIES STORMWATER PROGRAM CITY MGR. RECOMMENDED ACTION: Adopt Resolution No. 200 I - 3 15 to approve and authorize Amendment No.1 to agreement with AMEC Earth & Environmental for Municipal Facilities Stormwater Program. ITEM EXPLANATION: The City is required to prepare a Jurisdictional Urban Runoff Management Program (JURMP) to comply with the NPDES requirements contained in the San Diego Regional Water Quality Control Board’s Order No. 2001-01. One component of the JURMP concerns “Municipal Facilities”. Under an existing agreement, AMEC Earth & Environmental (AMEC) is assisting the City by reviewing and documenting existing and also recommending proposed stormwater protection measures at all Municipal Facilities, such as maintenance yards, fire stations, office sites, roadways, stormdrains, etc. Amendment No. 1 with AMEC incorporates three additional tasks including: b Develop pesticide, herbicide, and fertilizer management protocol b Develop municipal facilities inspection program for use by City staff b Prepare a “Municipal Facilities” summary report for incorporation into the City’s JURMP. Total cost for Amendment No. 1 is $20,815. ENVIRONMENTAL IMPACT: The investigation work and report to be prepared by AMEC is exempt from CEQA in accordance with Section 15306 Information Collection. FISCAL IMPACT: The existing agreement with AMEC is for a total amount not to exceed of $27,480. The additional work under Amendment No. 1 is for a total amount not to exceed of $20,815. Therefore, the total cost is $48,295 Funding for this project is available from the Storm Water Protection Program previously approved by the City Council. EXHIBITS: 1. WHEREAS, the City is required to prepare a Jurisdictional Urban Runoff Management Program (JURMP) ; and WHEREAS, a component of the JURMP includes the City’s Municipal Facilities; and WHEREAS, AMEC Earth & Environmental has an existing agreement to assist the City with documenting current and recommending proposed practices to comply with the stormwater quality control requirements from Municipal Facilities; and WHEREAS, the City requested an Amendment No.1 to the existing agreement to develop pesticide, herbicide, and fertilizer protocols, a municipal facilities inspection program, and preparation of Municipal Facilities Summary Report for incorporation into the JURMP; and WHEREAS, the total cost for Amendment No. 1 is in the amount not to exceed of $20,815; and WHEREAS, there are sufficient funds available in the Storm Water Protection Program budget for Amendment No. 1. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. This Amendment No. 1 is entered into and effective as of the &?wD day of /1/6U~hf3GK amending the agreement dated September (the “Agreement”) by a2nOd0ketween the City of Carlsbad, a municipal corporation (“i&“)2i!/ AMEC Earth & Environmental, Inc., (“Contractor”) (collectively, the “Pat-ties”) for &vironmintal engineering services. RECITALS A. The Parties desire to alter the Agreement’s scope of work to develop pesticide, herbicide, fertilizer management protocol, develop municipal facilities inspection program, and prepare JURMP; and B. The Parties have negotiated and agreed to a supplemental scope of work and fee schedule, which is attached to and incorporated by this reference as Exhibit “A”, Scope of Services and Fee. NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, City and Contractor agree as follows: 1. In addition to those services contained in the Agreement, as may have been amended from time to time, Contractor will provide those services described in Exhibit “A”. 2. City will pay Contractor for all work associated with those services described in Exhibit “A” on a time and materials basis not-to-exceed twenty thousand eight hundred fifteen dollars ($20,815). Contractor will provide City, on a monthly basis, copies of invoices sufficiently detailed to include hours performed, hourly rates, and related activities and costs for approval by City. 3. January 5,2002. Contractor will complete all work described in Exhibit “A” by 4. All other provisions of the Agreement, as may have been amended from time to time, will remain in full force and effect. 5. All requisite insurance policies to be maintained by Contractor pursuant to the Agreement, as may have been amended from time to time, will include coverage for this Amendment.
